Just a quick post to note our successful claim against monarch - 600 euros each.
A big thanks to Martin & MSE for the update on the EU ruling and the template as we had previously had our claim put on hold - effectively rejected.
Flight details for those who may have been on the same flight:
ZB685 - Sharm to Manchester on 07/04/12.

Anyone had compensation success on the following flight?
Malaga to Manchester on 2 August 2010 with Monarch Airlines.
Depart Malaga: Flight ZB 661 Time: 20.25
The flight was due to depart at 20.25 hours but on arrival at the airport we were informed that there was at least a 7 hour delay until 3.30am. The reason given was 'a technical fault'. No other airline departing from the airport that evening had a delay, only this particular flight. I was travelling on my own with 2 young children (twins aged 6 years) so this delay was an extremely stressful situation for me. Niether of us got any sleep that night and I had to cope with problems and bad behaviour caused by their sleep deprivation. It took us 14 hours to travel from our holiday accommodation to home!
A friend of mine had travelled on the same flight the week previously and suffered the exact same 7 hours delay for the exact same reason - 'a technical fault' :question: He called me from the airport and said not one other plane had a delay - only his!
Furthermore, there were a number of regular UK to Spain travellers at the check-in desk that evening who all confirmed that Monarch had done the same thing (advised a 7 hour delay because of a 'technical fault) for the past few weeks. A couple even insisted on a refund so they could book another airline instead saying that they knew the same thing would happen again if they arrived for the same timed flight the next day, because, they said, 'it just keeps on happening'.
I spoke with a friend who is ground staff at a London airport who thinks that Monarch were not circulating enough planes during the busy summer season and using the excuse of 'technical fault'.
I wrote to Monarch to request compensation for the delay. They eventually replied (after 4 weeks) apologising but denying compensation. I wrote to them again quoting “EU Regulation 261/2004 and that compensation could be claimed for such a long delay. They failed to reply.0 -

Just as a quick update, still nothing from Monarch despite me emailing them again, not even an acknowledgment of our complaint so I spoke to a solicitor via my home insurance (been paying for legal services for years may as well use it!) who said that they feel from what we have said the airline will just pay up. I said I felt it was unlikely from what I had read here so he said before we go to court, it looks good to put the complaint into the CAA first, to show we have tried to resolve first. So having just done that I wondered if anyone else had and how long it took to get a response?

Seven months and waiting for a CAA response ... about the same for me...... although I did win in court on the 8th July and they were ordered to pay within 14 days.......

you can do it yourself, if I did anyone can.... all you need is on this thread all the links and advice and help.....
download the Wallentin report and read it at every opportunity ( I know broken record) all the answers are there....
and if your stuck there is help here also.... your solicitor will take months, ti will be something eh does in between cases.
If you do a little ground work, it will pay off, too many think it's just a case of asking for the money and you will get it......

I believe the route to go is "The Sheriffs" (Google them) not a Bailiff.0 -
I too was on the same flight MON1875 and have just sent my letter to Monarch. Will let you know when I here from them.0
