    Someone asked me for the link .... here's the statement....

    New case management rules

    General case management rules were amended to ensure that judges are less tolerant of delay and breaches of orders. The Court of Appeal intends to support judges in being more robust about delays and breaches of orders. On an application for relief from any sanction imposed for a failure to comply with any rule, practice direction or court order, the court will consider all the circumstances of the case to enable it to deal justly with the application, including "...the need for litigation to be conducted efficiently and at proportionate cost; and to enforce compliance with rules, practice directions and orders"

    Centipede for the life of me I am trying to remember, there was wayback in the day of the bank charges a CPR you could use ot have access to documents prior to starting your court case, can you remember what is was or is?????......

    I was wondering if it woudl be of any use to people

    That's the kiddie.........I was wondering if it might be worth people considering making this request to the court as soon as claims are submitted......

    The general jist is the majority of the defence is basically the same, just the odd tweak here and there.......

    It's a different approach and may give claimants a little longer to get supporting counter arguments if they are required.... AND give an opportunity to " ask for the defendant to be put to strict proof to prove " etc, etc...

    just a thought, perhaps those with much more knowledge than me will give a view, itmight be a totally useless exercise;);)

    Hi all

    Tink we're about to enter the muddy waters of the claims process against Monarch. Is there a standard first letter template somewhere? Can't see one on Martin's article.

    We had a five hour delay but have little idea about the cause (think it was multiple - first plane was two hours late, then went tech. New plane needed and took a while to crew, refuel etc).

    I have proof we were on the flight and the info Martin advises, but anything else I should say?

    I'm a total newbie at this. Still deciding whether to ask the tour operator for general compensation (they switched us from their flight to Monarch scheduled) or go down this route.

    You guys all seem pretty experienced. Any help please?
