    Just an observation people,the list of Monarch flights with compo rejected for ecs is now up to around 120. Bearing in mind the meaning of the word [extraordinary] surely the list is evidence in itself that these problems are NOT EXTRAORDINARY !!

    I still have received no witness statement from them, and nothing from the court either!!!! about the claim being combined!!!

    Not long to go either...:(

    Any more details? Did they turn up in court and settle before you saw the judge? Do you actually have a *court order* that says you have won?

    I think the thing to do people, if you get as far as court and a win, is to ask the judge to include for (extra) interest to be payable if the payment is late.
    In other areas of Court work you can ask for a 'penal notice', but I don't know if that applies here.

    Can you add my flight: ZB 252 from London Gatwick to Alicante on 24.02.2013 to the list of flights that Monarch have paid out on as per post 2377.

    Has anyone had any luck with claiming compensation for the 11 hour + delay on the Manchester to Sanford flight? I have had a standard email rejection of claim on basis of "engine vibrations" and that constituting EC. Just wondering whether a group action for these flights may be worth considering? If not looks like CAA not worth bothering with and may go straight to NBA?

    Any thoughts?

    Just a brief update from me. I went through telephone mediation this week.

    Having explained the facts of the case to the mediator, I said in the interests of settling this before everyone goes to the trouble of a hearing I was willing to waive the court fee and interest, but expected my original claim for €800 to be paid in full. Quite generous and conciliatory I thought, as that put nearly £200 on the table, about 20% of my total claim.

    Monarch initially offered to settle this by refunding my £60 court fee, then upped their final offer to £100.

    Needless to say we are miles apart so I'm now waiting for my court date.

    From what the mediator told me, they are still relying on this flawed logic that 'according to the Wallentin judgment tech faults on a non-maintained aircraft do not equal extraordinary circumstances, therefore all tech faults on a maintained aircraft do'.

    If that is the standard of their logic and argument no wonder they are losing so many cases.

    I now look forward to taking them apart in the County Court in due course.

    A 'group action' is fraught with all sorts of problems. I can see it would be like herding cats, and would play right into Monarch's hands.

    Go straight to NBA would be my advice. Claim form -> NBA -> court ASAP seems to be the only tactic that gets their attention.

    Well court has also not received the statements from Monarch, with regards the transfered to our local court, it is still with the DJ, been with him about a week, they are still awaiting his directions......but original court date has as yet not been vacated ( keep everything crossed)..

    Husbands witness statement has been requested and sent, they have never requested it from me ( should I cry lol )

    It appears they are combining both claims into one, which is good, a court date in just over a week....
