    If they continue to insist on proof you were on the flight, make a Data Protection Act Subject Access request specifically asking if your name is on the Passenger Name Record for the flight concerned.

    I found that certainly gets their attention.

    Thanks FOBW2, I have already prepared my case which states that if the booking confirmation, Letter to delayed passengers handed out at the gate, and proof of 'Airside' vip lounge are not enough for Monarch, then i am prepared to obtain a copy of the boarding mandate via SAR with the proviso that the cost of this is returned should Mionarch be found liable.
    People also need to be advised that Monarchs boarding card stubs do not show the year of issue so I cannot see how they would be acceptable as proof anyway. I have a stub from the same flight, same date (Without the year shown) and same departure time the previous year coincidentally - that in itself should be enough to prove that boarding cards are not conclusive proof anyway.
    I suspect a judge would look rather unfavourably on Monarch if they insisted in court on seeing proof, when they are legally bound themselves to retain all the information that would provide proof anyway without putting the customer to unnecessary time, effort and cost.

    I take it I only need to offer my evidence once a date has been set? So far, all i've been asked to provide is my N180 yet Monarch have sent me their full defence.

    Good idea. If I'm ever delayed 3 hours plus in future I'm definitely going to do that, and retain the boarding passes.

    I think getting the stamp upon entry, - even if not delayed - is the way to go, as you have evidence in place that you was 'there' if the return flight is delayed.

    The flight was over 4 hours late leaving but made up a lot of time and arrived 3 hours and 5 minutes late.

    Wow, that pilot would be kicking himself! Just five minutes quicker and he would have saved his employer £10000s! I hope they haven't sacked him.

  • First post on this subject though i have been reading your advise etc. I put in a claim a few months back with monarch for a flight delay going to Menorca on 29/8/2011 (ZB698) and received the claim forms from them which i filled in and sent back and i received an email saying they had agreed to the compo for the five of us and we would be receiving a cheque within 21 working days. 21 working days have now passed and still no cheque. Am i being fobbed off?

    Surely if they have not submitted a defence you can ask for a judgement in its absence ?

    They have submitted a defence. this is the exchange of docs 14 days before court hearing. and you can bet your bottom dollar if we had not done ours, they would have :mad:

    I have previously posted regarding our 4hr delay from Faro to Manchester, with Monarch's usual 'no compensation due to extraordinary circumstances' line:

    Our records show that on the day of your flight, one of our aircraft was forced to divert to Dalaman due to an in-flight technical emergency. Due to the lack of availability of engineers in Dalaman, we did send one of our own engineers along with the spare parts required down to Dalaman, however, the scheduled flying programme for that day was affected. As a result of this unforeseen technical problem and the lack of availability of engineers in Dalaman, it was unfortunate that your flight was
    subject to an unavoidable delay as, despite Monarch’s best efforts, we were unable to transfer your flight on to another aircraft from within the Monarch fleet.

    As a consequence and in order to reduce the length of your delay, passengers on your flight were transferred to a ‘Euro Atlantic’
    aircraft which we had chartered to operate the flight on our behalf. As the operator ‘Euro Atlantic’ was based in Lisbon the aircraft was flown directly to Faro and we operated the inbound flight to Manchester, prior to operating the flight from Manchester back to Faro.

    Having followed the threads on here for some months, I was fairly sure that we had a claim as the flight affected was not even ours, so referred the case to EU Claims. I was very surprised to receive the following response from them after over 4 weeks:

    We have investigated your claim and must conclude that the flight was not conducted as scheduled due to an extraordinary circumstance.

    Due to a technical defect the airline was not able to conduct your flight as scheduled.

    In the scope of the EC Regulation 261/2004 you therefore do not have a right to financial compensation.

    If you want to file a claim for your additional costs you can use the following link:
    File your claim directly with the airline


    You can immediately receive a completed letter to send to the airline
    and a filled out complaint form (following the form of the European Commission) and cover letter to send to your National Enforcement Body. All documents will be sent directly to your e-mail address.

    Therefore we regret to inform you that we are unable to process your claim.

    We hope you have now been properly informed and apologize to have to write to you that we shall not be continuing with your claim.

    I'm really not sure where we go from here and would appreciate any advice. Is it time to drop our claim, or are EU Claims being ultra cautious?

    Dear All,

    Got my court date this August and im starting to get my paperwork together to file to court and Monarch.Need some advice please on what to submit in terms of my case against Monarch.I have decided to keep straightforward in terms of evidence i.e 261/2004 regulation and fact that Monarch defence is null and void due to it not being an extraordinary circumstance.
    My main concern is getting over to judge that my case was a previous flight issue and this does not apply.
    I would like to print off the Wallentin and Sturgeon case examples,can someone direct me to a site where I could print relevant parts for judge to read.
    Any other help directing me to other useful sources of info would be much appreciated.I did read someone previously had mentioned good sources of info in FAQ section but I can not see this there
