  • There is no concept of "group action" in the English courts as there is in the US for example so put that thought aside.

    NBA appears to be the way to go judging from the figures to date.

    I thought the poster was thinking of trying to combine a number of claims from one flight (Manchester -> Sanford) to keep the costs and admin down. It would theoretically be doable but undoubtedly fraught with practical difficulties.

    One booking with the airline = one claim = (inevitably) one court case is the only way to go.

    and Hi everyone, feeling a little delicate today. I just wanted to say thanks for all the messages.

    Now there were a few questions asked so I'll try to answer them all.
    The background to my case is a delay of 7 hours 41minutes on a flight from Luxor to Gatwick back in July 2008. Started the claim in December last year. Monarch claimed EC and I took out a small claims action in a Scottish court on behalf of my family of 5. Monarch offered £2000 then £2200 both refused by me. I offered to settle for £2400 Monarch refused. First hearing in May, Monarch did not show up but asked for an extension so we could negotiate a settlement. I was to phone Morgan Mulay as they were keen to settle. I phoned she was unavailable so left message for her to get in touch. A month passed. The day before the hearing 28/06 I received an email from her saying she accepted my offer of £2400. I replied it was too late, that offer was not acceptable. She was insistent I had to accept as I had not formally withdrawn the offer. There followed several emails getting more and more angry in tone that I must not go to court as I had to accept the £2400. She also phoned my house but I was not there.
    The next morning I emailed her to say I had appraised the court of the situation and had been told the Sheriff expected both parties in court that morning. I turned up and the clerk met me at the door to say she had spoken to Morgan who was not going to be in court so was told that the case would be awarded to me then. Morgan emailed the court to say Monarch accepted my claim in full and would pay. I stood up in court and the email was read out. The Sheriff asked if I was pleased with the outcome, which I was , and I was thanked for working out the compensation with interest of 8% but no attendance fee as this is not applicable in Scotland. There was then a continuance of the case till 25th July in order for the cheque from Monarch to not only arrive but to clear. The Sheriff clerk emailed Morgan with the resulting verdict and CC'd me in to that email. End result was £3411.68.
    The Witness statement was taken from one produced on this thread, I think by Vauban, just tweaked to suit my situation and never actually saw action! The hard work I put in to it was due to the fact I am not very good on computers and struggle to produce a document with all the italics, underlining etc :o

    Hi All
    My friends party of six are claiming for a delay of over 8hrs in 2009 but the claim forms state that they will not be eligible for flight claims of over two years ago also they need photocopies of all passports from 2009, is this correct? They do have the tickets as proof, grateful for any advice.

    Assuming your claim is under English law the limitation is 6 years so you are well within the timeframe.

    There is no justification for them needing copies of passports. They have no bearing whatever on your claim. The fact that you had them checked a number of times on the day you travelled and would have been prevented from travelling by the airline's staff had you not been able to produce them, proves for all relevant purposes that you each had a valid passport.

    If they say they can't process a claim without you jumping through all sorts of hoops, decide how much you want to put up with, send them your NBA as soon as you've had enough and a court claim 14 days later.

    It really is up to you how long you let them string you along.

    Just returned from Florida yesterday.

    We live in Newcastle but decided to bite the bullet and fly with Monarch from Manchester as it saved us over £1000.

    We last flew with them in 2006 and were delayed 9hrs in Sanford.

    At the time my wife was expecting our daughter so it was very uncomfortable for her...we vowed never to use Monarch ever again... Sigh!!

    Anyway we were supposed to fly out on the 14th of June at 07:30 but we we delayed approx 15hrs.

    As the Pilot put it..."A certain individual had placed the steps wrong and the plane had settled on them thus damaging the rear door"...


    I'm now in the process of submitting my claim for this delay and i'll also be submitting one for our delay in 2006...

    You're out of time for the 2006 claim - six years is your limit.
