Hi - 1st post on forum have just received cheque from Monarch from delayed flight (8 hours) last September. Despite many posts to the contrary, Monarch paid out without fuss in my case. Thanks to MSE and BBC Watchdog or I would not have known to claim.0

Sent in my claim on 1 April for flight ZB 715 from Larnaca to Gatwick on 23/09/2010 which arrived nearly four hours late. Not heard a word or even had an acknowledgement.0

You have the basis for a claim simply because they haven't answered you.
If you commence a court claim then their defence has to be submitted within 28 days.
You could always wait a little longer if you like being the spool on the end of a yo-yo0 -

Actually, there are a lot more successes than failures! You haven't heard of that many successes simply because the process is very slow. But eventually you will be hearing of more and more successes... and very few failures.
Now, your dilemma is whether to start court proceedings now or wait until they reply to you. Your post seems to imply that they haven't told you the reason for the delay. EU Regulation 261/2004 says they must tell you the reason for the delay (in writing if you ask at check-in). If they haven't told you the reason for the delay, they're already in contravention of the regulation but that doesn't necessarily mean that they have to give you compensation. It depends on the reason. If it was something like extreme weather or an air traffic controllers' strike then that would probably count as a legitimate extraordinary circumstance. If you don't know the reason, you may want to wait for their reply so that you don't waste the court fee (which won't be much anyway, so it may be worth going for it straight away).0
