I recall seeing a sample letter somewhere on the forums a little while ago and wondering if someone can point me in the right direction as I can't see it now.

It was an example of what to write when an airline has claimed "exceptional circumstances" and you want to advise them they have x number of days to settle the claim or you will take it to the small claims court.

    Any ideas anyone?

Sarah if you go to the first page of this thread there are links to loads adn loads of useful stuff.....

please feel free to do that, but it will be a wasted excersise they wont respond, or give you what they gave me......

Go to the CAA or court.....

If you have not given them 14 days notice, the do the LBA ( letter before action) or NBA which some call it Notice before action....

As the others have said, they are putting as many obstacles in people's way as possible to deter you and intimidate you and bully you....dont let them.....

The CAA are a total waste of time, I contacted them in January, the referred it back to Monarch, lol... and todl them to respond and deal with it... ha ha ha still waiting......

Centepede and the others are right court is the only way......:j:j:j

ZB677 Alicante to Manchester 7th july 2010 denied compensation as they claim EC, "Cockpit Voice Recorder fault that rendered the aircraft unserviceable" This was NOT the reason given by the captain of the flight.

Also have claimed for ZB677 Alicante to Manchester 13th Luly 2011 but despite a number of "urges" thay refuse to reply to this one.

Is it OK to serve "Notice of Court action" by email or should it be by snail mail and recorded delivery?

Firstly only issue if you mean 'business'. Snail Mail best but you do not need recorded just proof of posting will do. I would send two separate letters. Make sure you keep copies.
  • I've sent two letters to Monarch re delayed flight since February and filled in the form on their website re a complaint. I get an e-mail response and a ref. number but have heard nothing more. Can anyone suggest what I should do next, i.e. contact the CAA or send a recorded delivery letter to Monarch threatening County Court proceedings? The flight was delayed 8 hrs last May and was part of a package deal.

    Directions Questionnaire.

Is it is correct that i need to send 1 copy to court and 1 to Monarch? If so, addressed to the Group Lawyer that signed the defence or simply to Monarch Airlines Ltd?

I would not threaten... just send them a letter clearly stating if you have not had your refund with in 14 days, even give the exact date if oyu wish.... nothing more do not tell them you are issuing court action, jsut do it the,,,,

CAA waste of time....no point.... I cotnacted them 6 months ago.... they passed it over to Monarch to respond.... nothing happened...got a court date in a coupel of weeks...

CAA waste of time so forget that. Only issue NBA to Monarch if you intend going to Court. So up to you .... if you mean business go NBA with 14 day notice and court action thereafter or if you want to give them one more chance (I wouldn't) send them a 'reminder'.
