    Do ATOS keep claimants past claim/medical history on file.

    The shared computer system with the DWP retains a record of referrals for advice, how the referral was processed and the advice we have provided to the DWP. Atos Healthcare does not have access to any information about the wider claim. Any paperwork collected during the process of the referral, such as medical evidence and the ESA50 questionnaire, is returned to the DWP at the point advice is provided on the referral. At all times any information that is held is kept according to DWP data security requirements.

    Yes it is true; they have been harassing and threatening legal action to a number of disable groups and anyone else who says anything against them. They have even contacted website hosts and threatened them too.
    Really nasty company

    To MSE Andrea I personally think enough is enough.

    We has given the ATOS Rep a fair chance now and i also believe many posters have show a lot of restraint considering the gravity of the issue

    Due to the Back Bench Debate on ATOS people now know and this ALSO includes yourself MSE Andrea that most online posters and Blog writers arnt just Gratuitous, they are genuine people with a genuine grievance against a company that will not stop at ANYTHING in order to fufil its remit.

    It is now Friday please give this company Rep the shove/Flick /sack, from these board,they are not serving any purpose. You now know it!...... We all now know it!

    Please lets start on Monday without the ATOS Rep.

    Ps I would just like to add and make clear, this is not personal against any one person or the ATOS Rep currently on these boards.

    Its not my place to answer atos questions but,

    I believe I have read that they are paid £100 per "customer" So if this is true the more they see the more they get paid.

    Can the Atos PR person please let us know if this is true ?

  • 2 Questions please.

    Your opinion on Q1

    Question 1
    I have some very serious health issues which was the result of a quadrupole bypass leaving me with many difficulties including not being able to walk to far without getting out of breath and using my GTN, and my lungs filling up with liquid every day, I also can not leave the house until my medication has done its job which is about 2.30/3.00 pm
    each and everyday. I stated all this in my ESA50 and I've also sent in a medical report from my doctor but I was amazed that the Atos HCP (Nurse who I can not find on the GMC site) who looked at my case said "The level of disability is unclear" When all my paperwork sent in clearly states my limitations and was backed up by a report from my GP. Not only have they got this wrong, Atos for 12 months now; can't even get an appointment time correct knowing I can not leave home at say 10 am they send me an appointment for 10 am :think: to date I have had 11 appointments which have all had to be cancelled. So my question the Atos rep is simple: If you have read what I have written here? how can anyone make such a statement as this "The level of disability is unclear" and you can make this a general answer as I'm sure you will.

    You opinion on the Q2

    Question 2
    The Dwp's interpretation of Section 3(2) SSA 1998 is correct for 'Data Processors', The ICO still defines any organisation which 'offers and opinion which on the balance of probabilities, may alter a later decision' as Data Controllers, therefore the Dwp's interpretation in respect of forwarding information to ATOS Healthcare or any other contracted organisation, in view of offering 'an opinion' is in err of law.

    Twelve doctors employed by Atos Healthcare are currently under investigation by the General Medical Council over allegations of improper conduct.

    The doctors face being struck off if they are found not to have put the care of patients first.

    nogginthenog and halight, to obtain information about personal data held you can make a Subject Access Request in writing to the DWP, who are the Data Controller for all data generated under the medical services contract.
