I dont understand why it is her who has to come to an already over populated country .... why do you not go there ??

This is getting boring now, I am totally against any more immigration myself as we are as you say over populated. We are also basically broke as a country and cannot afford to carry anymore hangers on, BUT if he has met someone and fallen in love or whatever he should have the right to bring that person here, especially as they are going to support themselves

If you read the earlier posts you would have seen I was offered a role there but turned it down for financial reasons as what their market is prepared to pay for my experience isn't what I am prepared to accept. Love does not pay the bills.

Overpopulated? Lol. She will be living with me or in my other property so not taking a home from anyone else.

I am surely tempted to get her on JSA just to annoy the hell out of you and make your blood boil, but I cannot be bothered with the hurdles for the return, I really just want her in the NI system. She has 4 interviews in the City today and I suspect it won’t be long before she will actually be in employment so can then contribute her share to our nice society, and of course be eligible for benefits should the need arise. In fact as PAYE she will probably contribute more to the Government’s coffers than I do.

I've now read a bit more about the regulations, and I think she should immediately sign on as unemployed/a job seeker though -- and I do regret cheering up the EU-bashers here by saying this -- she won't be eligible even for income-related JSA until she's been seeking work for six months. Additionally, I think she should check whether any contributions she's made in her own country entitle her to contributions-related benefits here.

But I do understand your (and her?) inclination not to claim, given the hurdles. And I imagine she won't qualify for means-tested benefits anyway.

She won't need to wait as long as six months to be awarded JSA but as I stated in my earlier post the length of time she has to wait is down to the Decision Maker at the Benefit Centre.

About a three month wait would be the norm if previous Commissioners Decisions are anything to go by. The JSA which will be awarded to her will be income-based JSA if she is not living with you.

She won't be able to claim contribution-based JSA based on her contributions in her previous country if she hadn't claimed them before she left that country.

Could I just add that it would be nice if people on this forum just provide an informed answer to the question to help the OP and all other OP's who want advice, rather than rant on about the system. As it stands what I have advised is laid down in Social Security Law and that's the way it is - like it or lump it.

I'm sorry. I was simply giving the information I found on gov.uk pages.

Obviously you can, and also, as far as I am concerned, you may.

Its a forum, thats how it is whether you like it or not, next time Martin Lewis is on TV see if he answers just the question posed or adds another load of stuff on top
  • To those of you who wished us well a quick update. After 3 unsuccessul interviews where she was overskilled she had an interview today at 10am, got a superb offer at 1.30pm. Starts in a week. No need for any benefits, she has her NI number and will contribute happily for the next 30+ years.

Now I just need to switch my contract to one in London then we can be together,
