    Companies can write whatever they want into their terms and conditions, but I'm pretty sure that that doesn't mean that standard consumer rights and law are magically gazumped. That paragraph wouldn't for example make a company exempt from misadvertising and misselling?

    I agree.....a company using sale terms to protect itself from basically anything written on THEIR website, whether intentional/malicious/innocent it otherwise surely falls within unfair contract terms...?

    That term is the biggest loophole ever-basically we can offer anything, advertise anything, confirm anything, then void the contract purely because they feel like it-they have the new mailing list either way.....

    The worst part of that term is the 'inaccurate, misleading or un-true' part.....that infers they can maliciously and intentially provide incorrect information and allow people to book, then cancel the booking at any point.

    Taken fron UCTA 1977 basic;
    3 Liability arising in contract.

    (1)This section applies as between contracting parties where one of them deals as consumer or on the other’s written standard terms of business.

    (2)As against that party, the other cannot by reference to any contract term—

    (a)when himself in breach of contract, exclude or restrict any liability of his in respect of the breach; or

    (b)claim to be entitled—

    (i)to render a contractual performance substantially different from that which was reasonably expected of him, or

    (ii)in respect of the whole or any part of his contractual obligation, to render no performance at all,

    except in so far as (in any of the cases mentioned above in this subsection) the contract term satisfies the requirement of reasonableness.

  • Wow look what I started received a call this afternoon from a very sheepish booking.com apparently they had 99 bookings at £18 as far as I'm concerned I have made a booking paid in full I refused to cancel and I'm not going to pay £149 pn im happy to stick it out they prob dont want normal folk who got lucky in their hotel can't wait to see how it turns out I personally think they have done themselves as it clearly says on my booking I have paid at time of booking and its non refundable I mean they offered to cancel for free ahhh bless .
  • Also love the hotel posting their side of the story saying they tried to contact booking.com to shut it down etc the long and short is both companies can afford to take the hit they should be lucky it was only 104 bookings ( didn't see the other hotel !!) I have no sympathy suck it up if I go shopping in tescos and they undercharge me they don't come running out after me for the rest of the money that's their lookout

    Well lets hope the hotel, and booking.com think it is worth all the negative publicity they would receive from consumer websites, press, and possible television.
  • Well the advice over twitter is refuse to cancel and I mean who is going to pay £149 pn ?? If they could have cancelled the booking to be fair they would have done it already. I wonder if it was a PR stunt or a genuine glitch
    Not bothered as long as I get my room she after they have 'reviewed ' it they can come back and look like the good guys bet ya fingers crossed if I see anything on twitter will post the info. Just hoping you lot are going to chip in for my brekkie when you get your rooms £28 each what planet are these people on ??? !! I'll send my matey out for an egg mc muffin lol
