how will benefits be affected if my asylumseeker boyfriend movesin.

Lone parent on jsa.ctc.hb.ctb. just found out I'm pregnant. Partner is asylum seeker in detention.planning to try and bail him to my address. How will it affect my benefits. He's not allowed to work and no support. Will I have to look for 24 hrs a week during any hrs rather than current 16 during school hrs. Will my ctb be reduced. I'm considering applying for esa as im a longterm sufferr ofdepression. The stress is making me unwell again. How will my benefits be affected. He would stay with me until a decision made on his case.thanks

    His presence will effectively be ignored. You won't get any more benefits but as he doesn't earn anything then your benefits won't reduce. Why don't you marry him? I'm assuming as you are on benefits then you can marry him and sponsor him to stay in the UK. Marriage doesn't have to cost much just a visit to the registry office should be enough.

  • You are asking a very complex question, this is because your boyfriend will have 'no recourse to public funds' and any recourse he has could affect his stay in the UK.

    If/when your boyfriend moves in you will likely have to close your single claims to benefit and make joint ones... problem...

    The minute he moves in you will lose your 25% single person council tax discount so your council tax benefit will be payable on the full amount and will go up - meaning increased payments = recourse to public funds.

    Your housing benefit amount would not likely increase because you are probably already getting the maximum HB set by the local housing allowance.

    Tax credits may also be a problem.

    I strongly urge you to seek specialist advice from a welfare rights agency (legal aid will apply as you have a low income).

  • I knew my ctb would be affected. How would my ctc be affected as they aren't his kids and he has no income. So would I need to make a joint claim for jsa but id only get paid single rate.thanks.

    I do appreciate that what I'm going to say may well be quite offensive to you - but in the circumstances is it really the right time to have another child? As you say, you are a long-term sufferer of depression, and the circumstances that you describe are not condusive to your health and wellbeing - nor those of your other children. Added to that the fact that your b/f is not entitled to any benefits, and that you are proposing standing bail for him - how do you know that he will not abscond?

    Just think about it.
  • For tax credit purposes you should be OK as the Immigration Rules state that your boyfriend will not be regarded as having recourse by being part of a joint claim, if/when you get a job the couple element will not be paid.

    Re; CTB... as this is normally claimed on a dual form (ie HB/CTB in one form) you must state that you do not wish to claim CTB due to your boyfriend's immigration status. If you would qualify for more HB as a couple then this should not be claimed.

    you should really have done more research first. How much is the bail, when is their hearing, what are the detention grounds?

    Yes, it would be a single claim, if you were refused and appealed it could take up to a year to go through the reconsideration, appeal hearing, decision process. You would be paid JSA rate during this process and would need to submit medical certificates throughout.
