    Hi Guys..

Can someone confirm to me whether its 2 hours free, or 3 hours at the Shipley Asda store!

    This would be appreciated.

    Reading the posts above.

ASDA and the parking company say 2 hrs free, local council says 3.

Local council trumps ASDA and the parking company so put a complaint in to the council and drop ASDA in it.

Notwithstanding the fact that 3 hours is the time limit, I wonder who decided it would be 2 hours - ASDA or the PCC?

Isn't there a case for anyone charged for overstaying the period between 2 hours and 3 hours should be entitled to a full refund of monies paid? (I also accept the fact that even those who were charged for over 3 hours shouldn't have been so!!).

I thnk I'd be making representations if I'd been affected.

Well yes, but only if you'd been stupid enough to pay - and you are an MSEer now so please tell me you would never pay a private parking ticket.

From experience, The scammers will have left/set it at 2 hours.

The Otley branch have just had their legs slapped for similar issue. The Manager had told TCP/Smart to change it but they refused.
There was also comment on here about Asda telling the scammers to change the times at an Angelsey branch but again, they refused.

To assist the chap with the Shipley problem.
Get onto the Planning dept at Bradford Council and quote

Then get onto Tony Wilson, Parking Manager, Retail Development, at Asda and ask what he is going to do about it.

If they have breached planning, then i would also demand that ASDA refund anyone who has paid up as a result of receiving a parking charge notice, either bu ASDA getting in touch, or when a customer who has paid this charge returns to the store, via a refund from the till.

So it sounds like the tail is wagging the dog. If you look at a TCP sign it will say something like "this car park is managed on behalf of ASDA". So the supermarket have employed these morons and they should dictate the hours of parking, not the PPC.

    Who employs who here?

Also, on my local Asds/TCP sign it says contact TCP for full T&C's? So how can you enter in to a contract (assuming they had everything else right), if you don't know what T&C's you are agreeing to?
  • Ok...just rang Bradford Planning Dept...they don't seem to have a clue!!!

That reference 09/01848/FUL is for an app submitted by Asda in 2009 to increase the 2 hours parking to 3 hours...WHICH WAS GRANTED!

Now, i don't understand, because THEY don't understnad..what is definitive here!
The lady said, its been granted, but its up to them ! If the sign says 2 hours, then its 2 hours.

I pointed her to the article:
    theargus.co.uk/news/9031524.Aldi_fined_for_breaking_law_on_parking_charges_at_Portslade_store

..and stated, how can your Enforcement officers enforce anything, when your dept doesn't know if its 2 or 3 hours!

Atleast those in the Brighton planning office knew the hours..which meant they could take them to court!

She took my details, and said she would pass it on to one of the enforecemnet officers to contact me...but i am surprised, that the system is so lax that you can implement whatever hours suits you..regardless whether you have been granted 3 hours!

This is totally out of a logical way of thinking...how can you enforce, when you don't know if its 2 or 3!
She even stated it was nothing to do with them..until i pointed out its all part of the initial planning application and granting that application!!!!!!!!!

Anyone else like to have a go...the number for the Bradford Planning Dept is: 01274 434605

Somebody more technically aware could state more facts then me..and what exactly the Enforcemnt officers should be doing!

refering to fergie76 about t&c there was a post on here last year from a trainee lawyer who stated that unless both parties have input and agree to the contract then it is deemed invalid in civil law, so if you pull into a car park displaying their t&c and on it it says you agree to it then its tosh as you have had no input. If i am barking up the wrong tree here please let me know
