Hi there ALL HELP would be greatly appreciated!:)
MBNA ?????? - Cant get statements off them... But they cashed Thee £10 cheque that was sent with the original letter!?! on the 26th April2007!?! They have also exceeded the 40 day response - What action should I take now??
Alliance & Leicester £990 - After 2 mths of hard work i finally got an offer in the post FOR £175 which I declined giving them 14 days to transfer the amount requested in full and final settlement........ That was 7 days ago. Do I go to the courts this week to arrange small claims OR WAIT???

I live in NI and I was just wondering can I apply to the small claims in the courthouse in my own town or will I need to go to Belfast or Newry court?? I have only 7 days left to file my case as my latest correspondense with A&L declining their offer gave them 14 days to act accordingly.
Also I am at a bit of a loss retrieving my statements from MBNA any suggetions??

I was just wondering had you read claiming fees back in northern ireland? thread,posts 111,117+118?
As I like you when I sent my letter to Ulster Bank saying I would take them to court and I'd already gave them a list of the detailed charges. They have now replied-wanting me to send in photo-copies of my statements-highlighting the charges. They will refund me the cost of photo-copying and postage and it will take them 5-6wks to get back to me. I would have at this stage went on with the online claim but after reading the above posts, I think I'll wait to see what their response is. If I'm not happy then I'll send complaint to Financial Ombudsman. Just wondering what your thoughts are on this?0 -

You can do the whole court thing online, https://www.courtsni.gov.uk , you'll need to register but it's all very easy to do. You can monitor everything online as well. Or you can go get the forms from any courthouse, I stated Craigavon on mine as it's my closest one.

Don't think iv read them - to be honest i dont know how to search to find them?!
Not to sure on what to do about ulster bank - northern never said anything about a time-scale? I think i would do as they've asked, but put a letter in along with them stating that you want a response with 7/14 days or you will proceed with the small claims? At least then if it does go to small claims it will show that you've gave them yet another chance to settle with you!

Hi Nellie - I have just received my list of charges from the Northern bank and was amazed that they total £1,500. I am going to send my 1st letter tomorrow recorded delivery. Should I send it to the branch? Do you now if anyone has had success with NB?

From what I've heard, Northern Bank seems to be the easiest at getting money back - two girls out of my mums work have had Northern Bank actually phone them with an offer, and another one receiving a letter the same as mine. I've heard quite a few stories like these - all to do with Northern. They don't offer you the whole amount but 3quaters plus, is still a lot more than we originally had!0 -

On how to find them-go to the top of this page, you will see a light blue highlighted row, starting from the left-main site to the far right Log out. Click on search-then I typed ulster and you'll then see the thread claiming fees back in northern ireland?
Basically someone has said that the northern ireland courts have now suspended all bank claim charges until some sort of statement has been made.:mad:0 -
Oh keek, what do we do now? Can we still put a claim in or do we have to wait until we're told otherwise? If we wait does that not mean that the banks will think we've backed down?
What does it mean by some some sort of statement being made? Is it the banks or the courts doing the statement?
I'll post a thread (or watever it called!?) see if anyone knows?!0 -

I know this to be true as I was due in court yesterday, but I received a letter telling me the date had changed until the end of June, I phoned the court to see why, the listing officer sad the judge has suspended all bank charge related cases until some for of announcement is made. I asked will I be in court at the end of June then, she said, you may not if this announcement hasn't been made

I rang the court service this morning 90328594 and was put through to a guy who deals with the small claims. He told me they haven't been suspended but he mentioned they are awaiting to hear the outcome of a case in England. I'm sorry, I'm still a bit confused, I should have asked him to explain to me again. Maybe if you ring and see what you can make of it.
Thats why I was going to do what I was told by the bank and if I wasn't happy with the outcome then I was going to proceed with the Financial Ombudsman.0 -

I phoned the court service (said someone else had phoned this morning!;) )
He said pretty much the same as what he told you, but the case he's talking about in England is that a bank is defending a claim and intends not to pay out and that their hoping that this will be a predecident (think thats the word!) for other banks to follow, which i gather means that all banks are hoping they will win so that they can do exactly as them and win over here as well!?!?!?!? To his knowledge no one over here has lost but says he can't guarantee that that will always be the case! He hasn't heard the full story but because its them that mainly deal with it, he finds it a bit underhand?
I hope this explains it a bit for you all!
