Need help with claiming Bank charges in Northern Ireland

Hi Nellie
Glad someone to help us in NI started my claim in May now 12weeks in. I am owed 6000 in charges so I cant go down the court route. What are my other options having no response from my bank (first trust) only letter stating more time. Will the fo work0 -

Difficult one here because you have to ask yourself:
- am I happy to accept offer without interest (How much interest are you
missing out on?)
- will I want to make another claim if I am charged again and charges don't
go down
Personally I would hold out for the interest and the option to claim again. As regards the additional claim - does that mean you would be going back a total of 9 years or is the 3 year claim relating to a different account. The law only allows us to claim back charges up to 6 years at present.

Yes, the Financial Ombudsman will work but you do have to submit your case to them, the links are in Martin's article.0 -

12 weeks is more than enough time for them to get their act together so be tough and do one of three things:
-write back saying 7 days for return of charges plus interest or they can tell a judge why not
-lodge an immediate claim with the county court in Belfast
-lodge a complaint with Financial Ombudsman
You can still go the court route but it will not be the small claims court as they only allow a claim of up to £2000. As it is such a large amount you should consider going to the Financial Ombudsman and making a formal complaint. Martin's site has a great set of templates which can be cut and pasted to suit your own circumstances but if you need any assistance with this then pm me.

The interest would amount to 737.00 The business account has been closed for a few years. I read that you could claim back further than 6 years on Martins site but I was going to fight the 1st claim 6yrs then fight them for the previous 3 yrs.( would the loss of interest equate to the charges the bank should have charged. )0 -

I am having problems with getting statements from Halifax regarding my credit card, today is day 55. I sent the request with the £10 recorded delivery and also sent the reminder after 30 days. I rang them on day 40 and on day 47 still no luck, i emailed ICO and they said to give them a litte more time. Was thinking of emailing the Chief Executive directly like u had suggested in an earlier posting, do u think this is a good idea ?

I've got a claim in with BOI for 1500.00 + Interest but they have offered 350
Despite threat of court action they are sticking to their guns so i am about to go to small claims court0 -
Absolutely and if you can get a personal address for the CEO then send it to his house - they dont like that one bit!! The ICO will contact Halifax and it might take a few weeks (think ICO have been inundated) but you will get the statements and at least then they will get the idea that you are serious and will take further action if you have to. Stick with it!!

I dont think think the £737 would be connected in that way. By the look of it they just dont want to pay interest. You should push for settlement of interest as well because after all by taking illegal charges from your account they have deprived you of the use of those funds which you could have invested and earned interest on over the years!!

please help
has anyone been successful in reclaiming charges from first trust bank in northern ireland. i have asked for £3431.00 plus £706.30 interest. they have refused and it is now with financial ombudsman from start of june. i spoke to FO on 11 july and they said they are expecting reply from bank within 7-10 days(apparently the bank have told them this!!!!)
what do you think my chances are if any of getting full money back?

I would say your chances of a full refund plus interest are pretty good. Allowing this to go to court means the Bank has to defend itself by revealing how its charges are calculated and none of them want to do that. Stay with it, only short time to wait.
