I'm sure a lot of people will feel more uncertain since the introduction of the Protection of Freedoms Act. What is certain i'm sure is that the BPA and its members will be absolutely seething about not getting what they wanted: i.e. the same power to issue penalties as local councils?
Not sure if the Government deliberately gave them something useless or whether they were actually hoodwinked into legislating - don't suppose we will ever know.
I have no doubt that parking companies will be feeeing pretty sore at the moment and with a Government run by out of touch public schoolboys who knows what could happen in the future.0 -

I think there was knives out for the BPA and PPC's within the civil service, especially when it transpired the BPA lied about the number of tickets going to court, so the Civil Service stitched them up with a law that looked good but in fact was useless and pointless, in the full knowledge that having now legislated, no government will give any more attention to this issue for at least ten years.0 -
Thanks for the advice! I will write to the hospital and ask them to cancel the parking invoice. Should they refuse, I will simply ignore any further communications from CP Plus Ltd.
How do you think I should word the email? Perhaps something like this?:
Dear Sir/Madam,
RE: CP Plus Limited Charge Notice No.: 0000000
I write to you requesting that you cancel the above Charge Notice issued by CP Plus Ltd. The notice was issued whilst escorting my disabled, elderly mother to an eye operation recently at your hospital. My mother is a wheelchair user and as such completely warrants the use of a disabled parking bay in a private car-park. These facts can be substantiated by the staff on duty that day.
Please confirm in writing within seven days of this letter, that the above has been cancelled. Should this confirmation not be forthcoming, I shall have no option but to issue a claim against the hospital for a breach of the Equalities Act 2010. I would like to remind you that you are responsible for the action of your agents (in this case, CP Plus Ltd), therefore the liability falls with the hospital.
On another note, I feel it important to convey that the care received at the hospital has so far been exemplary.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

That's OK except it's the 'Equality Act 2010'. There is no 'Equalities Act'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just a quick update of sorts...
Calling CP plus is a waste of time as no one answers.
The early payment discount has now expired and apparently i owe them £90 ( dream on ) although other than the original letter, i have yet to receive any further correspondance from this company.
maybe they've seen sense, and that will be that.
I'm still Planning on visiting the site, and speaking to the 'duty' manager i know it probably wont get anywhere ( thanks for the reply s above) but if people sit back and do nothing then there's no hope of making a change.
But for now I'm still ignoring them, if they send anything else i may change track slightly, just to put them through the popla experience.
There's no mention on the original letter on how to use popla, and there's also no mention of any time scale to "appeal" so for now its ignore.
As for further research the only thing that is causing some doubt in my mind is the information contained on another car park company site - combined parking solutions, regarding people who ignored them and had their house re-possessed and huge fines levied by the courts. I realise from reading on here the bloke who runs it is a bit of a character/rogue, but how likely would it be that what one company does (combined parking) is repeated by the others.
Regardless of which even if the charge was a legitimate thing, i was not in the car park for the amount of time they claim, first visit in, second visit out ( some hours later )0 -

Of course what that above article fails to mention is that if a motorist does actually receive proper court papers then they should then stop ignoring, put up a proper defence, and then they would have a very strong chance of winning. That's what all the the "armchair lawyers" advise on here - ignore until you receive proper court papers.

Again many thanks for the advice so far, i was having a look through other sites yesterday, hence the minor wobble over the stuff on that other site.
reading it again in the cold sober reality of morning does show a different light on it so to speak, was the web developer paid by the word?
Anyway..
Looks like i spoke to soon about the letters, CP plus must love me after all, as ive received another one, interstingly this new letter states "A notice was sent to you on_______ which gave you 14 days to pay the reduced charge or challenge its issue"
but the first letter said nothing about a time scale to issue a challenge.
I have now signed up to an online photo sharing site, and using a scanner and microsoft paint ive uploaded the letters having a look round I havent found any examples of the latest CP plus junk mail so here goes ( if i can get images to work on here )
Letter 1 Front:
note no mention of any expiry time.
Letter two front ( i havent found any post october 1st versions of these anywhere):
Look at the bottom left, looks like my time to appeal is over???
and a look at the back, both are the same0
