I think it's fairly hard to go beyond 3000 texts. I was a text addict and texting every day multiple pages, I had only managed to get to a record of 2100+ in a month. That was with my phone out all the time, so god knows how you managed to get over 3000. Usually when you go over a specified contract limit, they tend to double and triple charge for each additional text, so it is possible if you were able to go over the 3000

If a text goes over 160 characters, on some networks this counts a 1 text for every 160 characters, so 1 could equal 3 or more.. Some convert to mms if over 320 characters.

Perhaps because the ASA (Advertising Standards Authority, no less) decided that when used in connection with marketing statements, a fair use stance is acceptable.

There is also similar claims 'VAT Free' which is totally bogus - but the ASA accept this means a 20% discount.

A dictionary definition is similarly pointless if a FUP is stated - that said, this is not any 'defence' of the networks, but a realisation for the consumer that if it sounds too good to be true, it probably is. Not researching what is on offer remains the caveat for the consumer. Just as marketing statements for fibre optic broadband (when you don't get fibre) and 18 month contract (when your contract is not of this length, only the minimum term) are all open to interpretation.

ASA maybe happy for Mobile phone providers to mislead the public but a SCC judge is highly unlikely to take side of the provider also.

There is no reason for a consumer to research what unlimited means and people who think they should have clearly been brain washed by the large business who have no interest in offering good customer service.

Contracts for the consumer have to be reasonable and easy to understand. Hiding behind the small print in the terms and conditions is no longer acceptable.
  • Since when does an arbitrary decision by the ASA have any bearing on a court of law? Seriously....
  • Just again to thank you for the input, I am hoping that with the help received here I may be able to overturn their decision.

As yet I have had no contact from Vodaphone reps, I dont know how long it takes to respond but I sent a link to this thread last night to Heidi.

I am very worried though as I dont have this kind of money. Will they just take the money out of my account or will I be billed ?

What happens when you call 44555 to check your balance.

It should either text you saying 3000 texts or Unlimited.

Heres some more evidence that might prove useful.

That's 133+ texts a day on average! How do you find the time to post on here as well?
'Unlimited' has always been subject to FUP, as defined in your contract.

I've got a teenager that can probably send 100 in the time it takes me to send 5. He's of a generation that uses it in an almost disposable fashion, and they can very easily top 3000 in a month. I couldn't do it, but then I'm not 16.

No question it should have been mentioned upfront at point of sale. He ended up being put on a tesco contract that was capped.
  • Called that number and it says 3000 texts. I dont know how to add a picture as I could have posted my latest bill which clearly states how many calls have been made and it also clearly states 'unlimited texts'.

I havnt been contacted back via the email I sent which was FAO Heidi 2 nights ago so I again called customer services. Basically yes she was aologetic and could see where i was coming from and I asked her to check my latest bill and pointed out it stated "unlimited" and no mention at all of 3000 texts and kept going back to when I 1st took it out but as I kept telling her I was told unlimited texts so I never for 1 minute thought unlimited meant 3000, she couldnt really help and had me on hold about 4 times so basically she has arranged a call back (in the next 48 hrs) from a supervisor :wall::wall:

Talk about stressed out for the weekend, I was hoping to at least speak to someone of authority who could help.
