Vodafone, when unlimited texts arent actually unlimited and charging me £157 !

  • I can see both sides here! I think that they shouldn't say unlimited when it isn't, because it is misleading. My £5 bundle on Tesco gives 5000 texts but it's under FUP of 400/day (I never use that much!!). I've always had FUPs as a per day thing. I would continue to dispute it though because unlimited means no limit!
They seem only to offer unlimited text plans, but texts charge 12p in their breakdown. Sorry I've no advice, but check your contract and keep talking to them.
    Good luck!

Unlimited should mean unlimited regardless what is in the small print.

Personally this is a situation that I would really consider fighting in the small claims court if the provider refused to back down.

I cant really see a judge accepting an arguement that unlimited does not mean that. If the limit is 3k text that that should be clear not stuck somewhere in the small print.

The question will be is it fair and reasonable for the average person to believe that unlimited does not mean that. I can't see a judge agreeing with the provider.
I agree - most people would be happy to accept a contract with 3000 text as being a bloomin' large number, but "unlimited" should really mean that there are no limits set.
  • Thank you for the comments, but if I can just clear up one thing, my bill and my Daughters phone and yes she needs a life lol.
The thing is I genuinely thought it was unlimited and she would never run up a bill like this if she thought it was capped at 3000, I do trust her that way.
I personally dont think she could have run up that amount of texts but if thats what they are saying then will have to take it as she did bearing in mind she has had this contract for qiite some time and she usually uses about 2500 ish so this is a hell of a lot more.

Im obviously going to fight this as I dont think i should be liable and if I were to go small claims way do I contact vodafone and let them know my intentions, or phone them again tomorrow and speak to another adviser ?
thanks for the help, much appreciated :)

Bearing in mind the comment I quoted in post #10, if it's an old contract, then go for a newer one where unlimited is unlimited - at least according to Ben and also get them to check her plan from the linl in my link, if you see what I mean.

    omg

The contract was taken out about 18 month ago but we changed the deal from Blackberry price plan to the one I have now, the only difference is its £5 cheaper as it doesnt have Blackberry messenger on. This was a 12 month plan so am tied to it till april 13........dont know if that helps.
But it deffinately does say on my online bill which i checked earlier "unlimited" texts and I print screened it.

Thank you for this, they mention sim only and this contract is SIM only so thats now making me think this contract is one of the exceptions ?
    thanks for the link/help.
