Have the banks got 8 weeks to reply?!!!

    I sent my first letter requesting bank charges after working out the charges from my statements and its about £1492 incl interest.

    I recieved a reply seven days letter saying exactly

    Thank you for your recent letter regarding the fees applied to your account

    we are currently considering your caim. Given the work involved in assessing your claim we anticipate we will be in a postion to repsond within 6-7 weeks but will endeavour to do so sooner if we are able to.

    Im just wondering is this a delay tactic and should i send the third letter threatening court action or should I give them 7 weeks till the end of July and see what they say????

    there is no 3rd letter- just start MCOL

  • Hi has anyone got any advice.

    Gone through all the letters with Abbey they keep delaying, letter to proceed with court action has been sent out heard nothing for over a week, then they sent a letter saying they were looking into this and it could take upto 4 weeks, even though the letter states court action within 14 day's. Are they playing with my mind and should i proceed with the court.:confused:

    The letters saying that they are investigating and will reply within 8 weeks are little more than acknowledgements of receipt and attempts to make you give up and go away. The 8 weeks only applies if you refer your claim to the Financial Ombudsman because you haven’t received a reply.

    If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.

  • I have followed the procedures suggested and submitted my claim for refund including interest. After 4 weeks no reply was received, so I sent the follow-up letter. I have now received a letter to apologise for the delay, advising that their research is takling longer than expected because "we want to make sure a full incestigation is done".
    They then tell me they will write again in 4 weeks time!!!!
    How should I react to this. Wait or escalate to the next step.
    Your views would be appreciated.

    If you want to use the Financial Ombudsman, you have to give them 8 weeks.
    If you want to file a claim, don't hang around and file now.

  • I sent the template letter to Nat West requsting repayment of charges plus 8% interest. Received a reply just within the 14 days saying they "need more time to consider my claim and should be in a position to respond within 6-7 weeks, but will endeavour to respond earlier if possible". My claim was fully detailed, item by item giving dates, amounts and what the charges were for.

    Is this just a stalling tactic? or should I allow them the extra time. Or should I write back giving them say another 7 days to respond to my request for a refund?

    Any advice would be appreciated.
  • Carry on with the timescale as it is set out originally

    By the way I dont think that you can claim the 8% until you get to the court action stage

    On the 24th April I sent off my 1st letter requesting my bank charges back totaling £1713.00.
    On the 26th April recieved one back from bank stating they are dealing with the complaint and will take up to 4 weeks.

    On the 9th May sent out LBA.

    On the 21st May recieved a letter saying they where still dealing with my complaint and I will recieve a response from them no later than the 22nd june.

    22nd June today and nothing.
    Should I phone the 08457 253519 number and ask them what is happening?

    I have tried to reclaim £475 from HSBC, sent first letter, then second, threatening court action, got a reply letter saying they were dealing with it and gave me a reference number. I phoned them up and they said it takes 8 weeks for them to come to a conclusion.

    Is this just a delay tactic to put me off, or are they likely to give me my money back?
