£35 is a paid item fee.
£28 is an unauthorised overdraft fee.
If you make a payment which is in excess of your overdraft limit (or none, if you don't have one) then you'll be charged both. If they bounce it, you'll only be charged one (a £35 unpaid item fee).
Given that it's the first time you can ask sweetly for it to be refunded and explain why the "mistake" happened. But they may just as likely say "No".
Don't go on about the fact it's only £4 as that's irrelevant.0 -

Before I start the charges reclaim process, just a point i need clarifying. I am a BoS customer with a branch in Edinburgh, but I have lived in England for over 10 years. which 'rules' for reclaiming charges will I come under - England & Wales, or Scotland?0

Right i have recived all my statments now.. between 13/oct/06 and 24/Apr/08
charges amount to £1584 (all "unauthorised overdraft" charge's)
i have an overdraft of £550 (put up from £250 last month, charges ment id miss my rent so i put my overdraft up)
im moving back in to my parents and i will have £0 outgoings! from the end of this month. and NO debt.
my question is will my bank (halifax) cut me a deal to clear my overdraft and close my bank acount costing them £550 meaning id loose £1034 but id be free from the overdraft. and financialy stable and able to start over.
i am working earning a good wage and i have a back up account for my pay if they agree to this.
yes or no? what would you do? would they accept? and how would i word it in my template letter to them?0 -

as it is probably obvious.
I am looking at, finally, claiming back the unfair charges as I have managed, after loads of problems detailed on another thread, to get a bank account with another bank that has just been upgraded to include a chequebook :j .
Anyway, I was with the Bank of Scotland for many, many years, with the "issuing" branch being in Scotland even though I have lived south of the border for all that time (it was a family connection that meant I opened an account up there and I was happy to have a manager who was 300 miles away!!:D ). Obviously BOS has since amalgamated with Halifax, resulting in each taking on the other's "bad bits" and the "good bits that worked" vanishing!!
So, my question is simple, really; can I put in a claim for five years or six years and, if the case has to go to court, would I have to take proceedings in Scotland or could it be down here?
As an aside, is Scotland being effected by the test case as they have a different legal system?0 -

What happened was my ISP the evil Tiscali took payment despite being £50 in credit meaning the direct debit bounced. I phoned Halifax who said they had the right to.and I argued.0

I have reclaimed over £4.000 from Nat West with no problems, in fact they could not have been more helpfull, now i am claiming £4,560 from the Halifax on behalf of my wife, Halifax have supplied me with the 6 years of statements but, in an enclosed letter they have informed me that they are not willing to take the matter further untill they have completed there discussions with the OFT, also they are insisting that if i choose to go the Court path, i will have to apply to the Scottish Courts for the Court case to be heard !! is this correct ? Please help .0

Know the feeling ! my wife recieved two letters three weeks ago informing her that two standing orders , one for £15.00 and one for £25.00 failed to be paid, so on the same day by the same post, two letters landed on the mat, informing my wife what she already new, and was charged £39.00 for each letter ! i contacted the Halifax and made them an offer, that was , if they withdrew the two charges i would consider not reclaiming 6 years worth of charges, the offer was turned down, ( a wise choice for them really , as i had no intention of not doing so, as i have recieved over £4,000 from the Nat West ) anyway the guy on the end of the phone was very insistent that the case with the OFT would be won by the Banks, so he had no reason to do a deal with me ?? if i was a betting man , i think his optimism might be misplaced .
