We have a client who, on 18th July 2007, started a claim against the Halifax through the Small Claims Court for the refund of £4K's worth of bank charges. The Halifax did not respond to the claim and judgment was entered against them on 9th August 2007.
No refund of the £4K was made by them to our client and in October we contacted them on her behalf to be told that they were unaware of any judgment against them. They have now applied to have the judgment set aside and we have a hearing this week.
We believe that, because her application was prior to the 27th July decision to put all claims on hold, pending the outcome of the test case, our client
is entitled to the money. Does anyone have any experience of the above or any advice as to how to persuade the judge that our client should be paid?

Halifax is one of the worst banks ive used. A&L are the only ones worse (so far). HSBC are the best ive used despite me currently awaiting the OFT results for my £1500 claim with them to be concluded.
To be honest there all pretty much as bad as each other but you have to bank somewhere :-(
Anyone have recent experience with First Direct? there new deal looks attractive but havnt loked at the small print yet.

:j I was delighted when I recently got intouch with the Halifax and after me telling them the OFT/FSA told me it was unlawful for them to charge me 8 x £35 for unauthorised overdraft usage, they decided to waiver 7 times £35! They think I will forget the one charge left of £35! NO! I have just sent them a letter asking for a list of charges over the last 6 years, I have included a cheque to the value of £10 for this service. I used the template from 'How to reclaim your bank charges', I am now awaiting their reply and will send the 2nd letter from the template needed to deal with reclaiming bank charges.
Normally I would just lie down and take it, but I have found the strength to stand up to my bank. So thank you so much Martin :money: . I am now getting a letter ready to reclaim a mis-sold PPI from Capital One.

Advice needed, please.
Recieved a letter from Halifax credit card, they are offering me £372.00 and have said they WILL NOT, UNDER ANY CIRCUMSTANCES refund interest:rolleyes: My total claim amount with the credit card is in my sig below. It's a big difference between the total amount they owe. They also said they decline my complaint and that the £372.00 is a gesture of goodwill:rolleyes: Should I take the money, or, what should my next step be?

They did this to me offering the difference between the actual charge and the new rate. I took them to court for £800 about £200 less than the amount i was claiming and they paid out. Stick to your guns or put a slightly lesser offer on the table. The costs of taking it to court are greater than a grand so you are in the better position.0 -

Always send a letter stating court action as then at least you have given them the oppertunity to respond (usually 14 days from date of letter) the letter should be the one in the reclaims section reference revised amount (i think letter 3 or 4 can't remember) either way let them know your serious and then when they don't respond take them to court. Remember use the justification as that they charge you 17.9% on any charge they issue you so you are adding that value as well as the 8% interest (only fair).0 -
I've had a current account with Halifax for the past 10 years, and I'd say that on the whole I've had a good record with them, though I've had the occasional minor overdraft problem.
Over the Christmas period I spent more than usual, but thought I was still within my overdraft limit. About a week ago I discovered that I was nearly £100 over my overdraft limit. I didn't contact the bank to discuss it as I was aware that I was already at the maximum overdraft for my account type. I expected to be charged about £30, which was manageable for me. To compound the problem I haven't yet received my pay for December as the payroll guy at my workplace has been away for the last month. I should hopefully receive my pay tomorrow.
This evening I checked my online banking and discovered that the bank intends to charge me a total of £245 for seven separate payments that they had accepted plus a monthly charge of £28. The majority of these charges will be deducted on 18-19 January.
I really can't afford to pay them so much. One of the charges was for my mobile phone insurance, which cost £3.99. The first four items were debit card payments I made before I'd even known that I was overdrawn.
When I first opened my account with the Halifax, they wouldn't authorise payments if the money wasn't in the account. A few years ago I even wrote to them to complain about the fact that they were accepting payments then charging me, but I never received a reply.
If they'd declined those initial debit card charges I would have realised there was a problem earlier and would have made other arrangements (used a credit card, or not bought those items at all). In my opinion, they've contributed to the problem and put a massive burden on my shoulders.
To add salt to the wound, I've realised that they've increased their unauthorised charge to £35 (it was £30 last year).
I plan to call them up tomorrow morning and ask them to cancel these excessive charges; does anyone have any advice for me?
I also plan to formally address the charges from the last 6 years by letter in due course, but I really can't afford to let them take this much money from me at once right now.0 -
I began the process of claiming my Halifax bank charges last year, it's a lot I'm owed, over £3,000. Problem is, I lost heart part way through. I got my data protection reply with all the charges, worked out the interest, and sent the letter asking for it back. I got a reply from the bank saying no, and saying if they didn't hear from me in 8 weeks they'd assume I was happy.I let the time slip away and didn't get it done. That was now around 8 months ago.
Is it too late for me to proceed? Have I agreed to anthing by not replying in the time they set? I know the cases are on hold now and that I'll have to wait, but can I even claim at all?0 -
Did they offer you Ombudsman rights? should say at the end of the letter. If it didnt then you should be able to copntinue. Write to Halifax complaining again.
If Ombudsman right were issued you have 6 months from the date of the letter so you are probably out of time.
Ive a feeling that you will be in the former situation0
