Hi if you read my previous posts you would have seen i was having problems with moneyclaim due to the wrong address on the submitted claim. I sent new forms on friday but that does matter anymore as halifax have come back and offered me the full claim of £806. Just goes to show the system works and you can get your money back if you try. Only thing to remember is when you use moneyclaim in HBOS's case always use the leeds address for halifax. Yay:beer: :j

Yes you can use that address but it would be better if you have a halifax card to use Halifax PLC rather than HBOS. Remember thought my original claim was for £1048. Did so calculation by myself and produced working out that if charged halifax the same as they did over the same time on the difference what the total and then added 8% for normal interest. I suggest you should relistically ask for about £850-£900 when you claim and that way you don't seem greedy. Your choice though and make sure that you annotate in the notes that you will add x amount per day for every day of work lost attending court.

I am in my third year of my second degree and finally after 7 years total of study I have actually gone over my overdraft by the grand total of £6.50 and incurred a £28 fee.

Now this is a little irritating as although I live mainly in my OD, I manage my money as wisely as I can.

I want to contest the fee but would rather do it in letter form.

The question is whom should I write to?

    My bank is Halifax.

The letter is electronically signed by the 'Managing Director of Banking and Savings,' but the address at the top is my local branch.

    Any advice??

    Cheers

To no department in particular, they say that they will take the money on the 31st Jan so naturally I want to get a response by then.

  • Just a quick question. I sent of my first letter back in June, and recieved a letter stating that they were not going to refund charges etc. However, this was sent to my Uni address, and I did not get the letter for a while. In the meantime, my local branch (Penrith) informed me that my account had been closed. Now I know that when I first got into difficulties with this account they suggested that it may be closed once I had payed of the overdraft, however I had payed of the draft nearly three monthes earlier, and had since been into two different branches and had the staff confirm to me that my account was not being closed (they even rang various other people up to confirm this). Oddly enough, the account was closed around the same time that I would have recieved the letter from the bank overturning my claim.

Now as far as I know, this is a dubious action on their part, however what action can I now take? I have not had the time to deal with this sooner due to moving house and job, and have only now been able to settle down and try and finish sorting this out. Do I go to Financial Ombudsman, back to the bank, try and take the bank to court or what??

Any advice would be very useful, and many thanks in advance.

Thank you but regarding Halifax currently charging £12, last week they did me for £39 for being £2.60 overdrawn:eek:

Hi allI went straight to Moneyclaim online when it came to reclaiming from the Halifax. Will let you know the progress but like everyone, am not getting anywhere fast. I've already reclaimed from two other credit cards and one current account. Having started them all around the same time, about nine months ago, I am still at this stage with the Halifax! Only just got the statements through, so as it has taken so long thought I'd take them to court if no response to my request for repayment within 14 days, which there wasn't. The charges are only £136 including interest, all from two or three years ago, and arguing that the OFT's recommendation of fees not to be over £12, Halifax argue they are offering me the difference; without interest; only £32. As it cost me £25 to do the moneyclaim online there is no way I accept this. I want the full whack, just to be difficult because they have been so difficult.Incidentally, they've also sent a stupid defence to the county court re the test case, even though it is clearly a credit card reclaim. I think this is just a made up legal document to scare me. Not sure where to go from here; I will probably phone them tomorrow and say I don't accept their defence or their offer, and see what happens! By the way, I used the Leeds address for my claim, and they've written back from Dunfermline.

As my previous post I have been hit with a £28 charge for exceeding my OD limit, this appears to have risen to £58 as I have had another bloody unexpected DD go out mid month.

I have been a student for 7 year and have only just tipped over the overdraft limit, so I do not think that I am doing to bad.

I spoke to a guy on the call desk about getting the fees dropped and he said that it was not possible (pleasant guy) but suggested that I call the customer service department tomorow and see what they could do.

What I am after is any advice that may make them see that I am not a serial offender and that I am just hitting a sticky patch with my finances?

    Thanks guys/girls

    Direct debits don't happen unexpectedly.

The DD initiator has to give you notice of the amount in writing, in advance.

You need to keep a diary of expected transactions if you can't remember them and if you are running your finances so close to the edge, in order to reduce your outgoings and related stress in future.
