    Hi,

    first would like to thank martin for all the advice so far. I have reached a bit of a bind. I have followed all the instructions on reclaiming my bank charges for my halifax one card so far and even got a offer which was about 4/10 of what i asked for. I have now filled in the form with moneyclaim and realised that Halifax have played a blinder. I filed in the address for the card services department of halifax which is located in dumferline only to realise after i paid the fee that the location means that the case will probably be thrown out as although the halifax main address is leeds the credit card is issued and run from scotland. This means i can't take them to court using the issuers address. I have spoken to money claim and they said for an additional fee of £40 (non refundable) i can change the address to leeds, i am warey of this as i believe that halifax will despute this as this is not the business address. Please help.

    For the first time ever, after 23yrs of working, we have incurred bank charges.

    We have a Halifax current account (held for 11yrs, joint with wife, c.£3000 per month combined salaries going in) and went £2.60 past our £100 overdraft limit because of a £17 cheque we overlooked.

    For this £2.60 debt we are being charged c. £60 for the £17 cheque that did not clear, going over the £100 limit and any interest.

    We've written a polite letter to the manager to ask them to rescind the charges and basically told them that our family (3 kids) has many accounts between us (current and savings) and we will "review our banking arrangements" if the charges are not dropped.

    We await their response but do I realistically have much of a chance with this case? £60 for £2.60 seems very excessive!!:mad:
  • the computer system will charge you if you go £2.60 or £26 over the limit. Maybe an idea to increase the overdraft incase this happens again with a cheque.

    They will probabaly reverse it for you as your first charge, but you don't really need to take the stance of all your families accounts, as it does not matter. the fact its your first charge is more important.

    Hi there,

    My first post here after reading the forums for a long while, so hello everyone and thanks loads so far with all the useful information on these forums! :)

    Anyways, back on track.... I'm thinking about making a claim for my charges but am a little worried about doing this since the 'test case' came in.

    I've read as much as possible about this, but still am a little confused on what exactly this means? Does it basically mean there is a high chance you will be taken to court? Should I not make a claim whilst this case is going through? (sorry if I'm missing some massive pointer somewhere!! :P)

    I'm with Halifax so dont know if that makes any difference?

  • I have just received an email from Halifax saying that they are going to charge me £39 for an unpaid DD to Egg, This is the first time I have missed a DD with Halifax as I have only been with them sinse June.

    It seems to me that since the reclaming the banks are starting to increase there fees.

    Maybe I should go back to barclays as there fee is still only £30.

    Go into the bank and dispute the charge, I did and they waived the charge. It's the first time I'd ever been OD and been with the bank years, and always kept the account in good stead so go in and dispute the charge. I would.

    Any one else had a call from these ? Im trying to claim the interest off the charges that they repaid me earlier on this year and the halifax said I was quite within my rights to go after the interest through the onbudsman service, ....they have advised me that because of the court case there is nothing they can do at present and do I wish to carry on or withdraw my case...they have had documentation from the halifax showing all the charges repaid and they reckon it was a good deal..
    I'm just going to leave it for the moment.. theres nothing too loose...:rolleyes:

    Well filled in the forms to moneyclaim online utilising the dunfermline address and guess what. The bank acknowledged my case and has decided to contest the full amount that i'm claiming for. Well at this point thought that they could be trying to get the case thrown out due to the wrong address and having spoke to several moneyclaim managers that's what they told me would happen. So filled in another form (N1) changing the address including all letters and another £40 fee to find i filled in the wrong form (doh doh) (8th Nov). Moneyclaim advised me this was the wrong form and i needed to fill in a N1cpc (has an additional area for a seal to be placed on it (honestly thats the difference between a legal document and a non legal document)). So i sat an waited for the mail to be returned. And waited ... and waited. Basically yesterday got tired of waiting and phoned Moneyclaim again asking where the documentation was as i was working to an imposed deadline. Ie had 28 days from the 8th Nov to get the address changed and make the claim valid. Funny that they sent the documentation back second class (what!!!!). Yep even though this was an open case they still sent the documentation back second class. (Note for everyone this is not on any web site stating that any mail will be sent second class unless postage is provided by the customer or special case's have been stipulated by the customer) After i ranted a little while (Please forgive me) i asked them about what possessed them to do this and they said it was my fault for getting the form wrong originally and mistake's happen. Ha Ha Ha. Any way am waiting for the mail to arrive so i can repost but will keep people informed.
