  • My husband wrote to HBOS on 20th July regarding refund of his charges. He was replied to stating that the bank were awaiting the decision of the high court as to whether customers could reclaim bank charges or not. They said until the decision was made they were not taking his request any further and the decision would not be made until January 2008.

    We have not had any update and to be honest this seems absurd as though they are just fobbing us off. I am about to write to them again so can anyone advise me of the situation regarding reclaiming as it it at present.

    On October 10th I wrote to my Halifax bank requesting my bank and credit card charges. Last week I recieved a list of credit card charges but no bank charges so, today I called the Halifax to remind them to post them out

    According to 'GALE' the female dealing with me on the other end of the phone, no one has been allowed a list of their bank charges from the Halifax since July 27th this year and that my request has been filed into storage to remain there for 12 months!

    That is rubbish by law they have to supply you with all bank charges or for a nominal £10 then they have to provide you will all your statements. I would go straight tho the FOS and complain let them take Halifax to task. The court case (July 27th) doesn't affect routine enquires which is all this is at the time.

    That's what I told her, she also refused to put what she had said in writing.

    I called again last night and spoke to a gentleman and complained. He said he had entered it onto the system and that I should recieve an explanation in writing. I told him I wanted my bank charges which I had paid £10 for and not explanations. I checked at royalmail.com to see if the letter had been signed for and it has been recieved by the Halifax.

    How have you got on with your credit card? I'm about to post my claim for my Halifax credit card. Should I send my claim to Leeds or Scotland?

    Hi Lee don't i mean don't use the scotland address as just had the mail returned from moneyclaim again as when i put the leeds address on i put halifax plc and the original claim was halifax card services so they have queried it again. I think sometimes HMCS isn't helping me but is helping the bank instead. The FOS is the Financial Ombudsman Service and you can contact them on 0845 080 1800 with your complaint and they will deal on your behalf with the bank although the processing time can be lengthy (i've seen some quotes of 3 months) When you do deal with them any correspondance you send include a self addressed envelope with a first class stamp and state that all correspondance to be returned first class or they will send in back second and you will spend lots of time twiddling your thumbs.

    Thank you for that:T The fact the FOS may take 3 months will take me over the deadline for my claim this year? Or, will it stand from the date of request for my bank charges, 10th October? The Halifax's delaying tactics are shocking, I have been with the halifax since I was 17yrs old and I'm now a grandmother.

    Sorry SEE i keep missing you and you log on after i log off but the long and short of it is that the FOS don't necessary have to get involved straight away unless you require it. What can happen is you state the complaint of the delay in responding to your initial letter and they will give halifax a boot up the bum to responed. They will first come back and say that your not intitled to a refund and then send the next letter and they will send a response to the extent of the difference between your charges and the maximum (for the moment) charge of halifax £12. If the charges are after jan this year they will be around £12 already. They will not add interest. It's at this time you can send a refusal back and demand more or settle (personal circumstances dictate this). When it goes over the 8 week date then either take it to moneyclaim or the FOS. Moneyclaim is relatively fast however Halifax will aknowledge the claim meaning that the process could take more than 1.5 months with possibly a court appearance required (or they my settle before the case). Or the FOS line (whom are very busy may take an additional 3 months after they have received the signature from yourself saying that you want them to get involved) this is where i repeat make sure you state the urgency of the case and ask them to send the details first class. Hope this helps.

    Thank you but regarding Halifax currently charging £12, last week they did me for £39 for being £2.60 overdrawn:eek:

  • Halifax credit card charges for late payment and/or over limit fees are now £12 in line with the OFT recommendation of April 2006, as for current account charges this will depend on which particular charge it is.
