Well its really up to you. What you need to do is work out how much of what they say you owe is made up of charges. If it is close to or equal to the amount they are demanding then they will have little to no chance of pursuading a judge to make you pay it if you do your homework and prepare a decent case.
I still don't quite understand what you mean by this:Nat West made a late claim against the online court procedure and got it.

Yes...you know the online summons jobby....I went to make the judgment after the specified time...I was 5 days late doing it as it happened, so they were well after the date appealing against it, and Cobbetts got it stayed because they said they had messed up on acting on it earlier! It was quite amazing!! It wasn't unusual on here at the time though!;)
(Excuse my lack of correct terminolgy...as it was a while back my brain declutters so I can't remember the exact verbage! *blush* I told the judge about the series of events in August and he was sympathetic but had no power after the OFT ruling to do anything. Pah!)0 -

Well, as I said, you can effectively tell them to get lost until the case is over. I can't see any good reason why a judge would not put a stay on their claim, if they dare to make one. But you must read up & understand exactly what you are doing, legal arguments e.t.c. I can help you out with some letters & arguments e.t.c.0 -
Don't be put off by the rudeness of the Halifax either. I had a call from their Collections team one evening asking me to repay the overdraft on my current account exactly the same day I received a letter from their Customer Services team telling me they were giving me £3,800 as a 'goodwill gesture'. The guy who called from Collections was the rudest man I have ever had the misfortune to speak to by phone and had my wits been about me more, I would have taken his name, visited Halifax myself and sought to tell the arrogant little rat what I thought of him face to face. Call went something like:
"Why aren't you repaying your overdraft?"
"Mr X in Customer Services has written to me, letter reference 123456, telling me that almost £4000 will be credited to my account within the next week after I've reclaimed my bank charges".
"Sure they did - is this just a story?"
"Er, well there's going to be a massive bank credit put in my account by Friday so I don't see what the issue is over being £27 overdrawn. Why don't you phone Customer Services and check with them?"
"It's your account - you phone Customer Services and tell them to phone Collections and tell us whether your story is true or not, and anyway, why are we giving you that amount of money?"
"I reclaimed your charges as unlawful"
"They aren't".
"They are".
"You're lying - who said they're unlawful".
"The OFT".
"I'm not asking the OFT, who said they're unlawful?
"The OFT"
"I'm not asking them, I'm asking you, you liar. Why did you reclaim your bank charges?"
"If they're so blinkin' unlawful, why didn't the Halifax face me out in court over then then?"
"Well the OFT don't matter to me - when you paying back your overdraft or are you just going to give me more of your stories and lies?"
"Away and **** yourself then you little call centre ****".
Ok, I was out of order calling him a **** and a ****, but it was appropriate at the time!
Don't expect courtesy or respect from the Halifax as there's little communication between their various departments which often leads to very frustrated customers (not like me to call somone something as horrid as a ****!) getting called liars by members of staff who don't know what their own organisation have agreed to. The transcript of my call certainly revealed a lot about the manner of some of the call centre agents.Almost debt-free, but certainly even with the Banks!0 -
God help us Bathgate. I despair. I really do. Reading that whinge from the bank girlie in her letter above I have received plenty more like yours though that just about takes the biscuit. I won't be called a liar...:shocked:

Hi, first time post, not sure if i am posting in the right place.
I have an £800 overdraft and when ever i have gone over that in the past, which is once or twice. My card fails to work as i have no funds, which has always been the case. Halifax have never let me spend over the £800. Recently, under that pretense, i was using my card, when one day it didnt work. I assumed i had gone over the £800, but i checked my balance and found that Halifax allowed me to go £300 over the £800 limit, without notifying me of an unauthorised overdraft, which i would have not agreed to.
On top of that, they are fining me nearly 3 times that amount, i have wrote to them requesting a reclaim of all my fines, i have also spoken to a branch advisor and customer services. But i received a phone call today saying they are to issue a default notice.
Is there anything i can say or do, help much appreiciated.0 -
We are claiming from Halifax. Back in July they wrote offering 50% of the charges. We wrote back saying we did not accept their offer and wanted the full amount. After the hold was put on cases we received a letter saying they would still honour the 50 % offer in full and final settlement. The letter said if we wanted to accept we had to return the form. We didn't return it and are sitting waiting to see what happens in the case.
In December we were advised that an agency pay slip had not been paid back in July. Looking back through the account we noticed that in July, at the time of the original letter from Halifax, they had already paid in the 50%. We didn't even notice it at the time as we just thought it was the agency money.
Can anyone advise whether this is going to mean that they will say our claim is settled? I think that is really sneaky as the money has been spent long ago and we can't raise the £500 + to give them back and they probably know that!
Also if the case is won will we need to put a new claim in for the charges they have taken since our original claim?
They are outrageous! One paid item and they charge £35.00 + £28 unauthorised overdraft fee. They take the charge before you get paid causing you to have another charge of £35 just to pay the original charge. By the time you get paid it is all eaten up in bank charges and the cycle starts again the following month. The banks are disgraceful as they are simply perpetuating peoples debt unnecessarily in order to make more money.:mad: :mad: :mad:0 -
I got a phone call this morn to say that my account was overdrawn. An account only used for 4 small direct debits monthly. My mistake it went overdrawn at beginning of Dec. Apparently they have sent 5 letters (3,14,31 Dec and 1 ann 3 Jan) but I haven't received a single one. I unknowingly went £4.01 into debit on 3 Dec but I now have bank charges of £244.00. I paid this amount today so no more charges could be incurred. I have only gone overdrawn once before and that was because a retailer refunded money into wrong account. On that occasion a Martin's letter and bank refunded £90 charges.
Halifax say my query should be with Royal Mail but How can I prove that I have not received these letters?

If you have not accepted their offer, you have nothing to worry about. The offer was conditional upon receipt of your acceptance, so in law, it has not been accepted. Best bet is to wait for the test case result, and take appropriate action once that is known. It might be worth getting in your claim for subsequent charges, to beat the rush!
I totally agree with you about the Banks - Might it be an idea to move to a Bank that does not take charges at the time of the crime, as that makes life a lot easier.0
