    Some advice needed, still waiting for over 2.5 years of charge details after receiving about 2.5 years worth.

    I sent my initial letter on the 7th December 2006, so do I count the 40 days from the date on my initial letter or do I take into consideration the christmas holidays?

    Who do I report them to if they don't deliver on time and how willthis help me?

    Any advice welcome

  • Halifax Bank of Scotland have charged me £764 over five years for bank charges, excess overdraft charges etc and I wrote them in December making a claim. I advised that they had 14 days to provide me with a full response, otherwise I would commence legal proceedings. They responded with a standard letter and a leaflet stating how they would deal with the complaint. A further letter arrived today, 4 weeks after my letter. This advised that they were still investigating my complaint. Last wednesday, I submitted my statement of claim to the sheriff clerk at my local sheriff court. This should by now have been served. I look forward to getting a much fuller response to my complaint and summons once they have realised I am serious.

    Started a claim against Bank of Scotland for £400 in November on behalf of my boyfriend, sent first letter and got standard 'sorry you're unhappy, we'll get back to you in a few weeks.' Sent 2nd letter - the LBA - just over 14 days later on December 12th and once again got a standard reply saying they'd respond by January 24th.

    In the meantime, the charges went up to £682 so we submitted to the Small Claims Court last week.

    Small claim summons would have been served on Friday I think - so it was obviously a coincidence that on Saturday they finally replied to the LBA.. Standard 'we believe our costs are fair' letter offering goodwill gesture of £447 full and final. As claim is now for £682 plus costs and interest, we'll reject - am I right in saying I should send something like;-

    "I write regarding your offer dated 12th January 2007. I cannot accept this offer of £447 as full and final settlement of my claim, which now totals £682 as detailed below – and I understand a further charge of £28 is also due to be charged to one of the above accounts. I would accept this offer only as a part payment and without prejudice.

    I have not received a satisfactory response within my specified time limit, so I have issued a claim in the Small Claims Court for the charges plus interest plus court fee. I am now prepared to let a judge decide upon the lawfulness of these charges."

    Any advice/comments appreciated!

  • howdy, sending my letter to ask for account satements today to see how much money they have robbed me. Cant wait it should come in handy. This bank has really !!!!ed me off.

    I'm in the process of trying to claim money back from Halifax Bank of Scotland. I sent them the initial letter and they replied within the 14 days saying that they were looking into it. That was a couple of weeks agao now - shall I phone them up and ask what's going on? What have you all done in this situation?

    Don't phone them.

    As soon as your 14 day deadline is up go on to the next stage and send the second letter.

    Just to add my bit - I followed the process with BoS, got replies to both the 14 day and 7 day letter saying they would be back in touch within a maximum of 4 weeks. In the end, it was about 7 weeks from the date of the 1st letter before we got anything back, which was actually an offer for the amount initially claimed - but by then, it had risen with more charges. We'd already submitted to the small claims court anyway. If you wait, it could be a long time and there are no guarantees they will make you an offer, they are just buying time. I would go ahead with the next step.

    Our return date is 22nd Feb so hopefully we're not too far away from full settlement now.

    hey all, How is everyone getting on with this then.

    I got another letter stating that for my complaing ragrding bank charges to my current account then would now need untill 14 feb 2007 to reply.

    I started my proceedings on 17 novermber 2006 and is takingm e alot longer to get BOS to pay up.

    Im going to wait for the 14th to see what they say but my credit card is another story.

    They sent me a letter as you will see on page 2 or 3 stating that they would not be giving me a refund as the believe the cost to be fair and within terms and conditions. So in reply to this u threatened with court action and am now waiting on the letter to come back within the 7 day period.

    if they do not respong or offer a settlement figure i will be heading down to the court to commence procedings>

    will let you all know how i get on.

    But anyone else having the same problems just post on here as it will be handy to find out how everyone is getting on.
