  • I think from my dealings with the small claim and legal process the 40 days start from date of service i.e. the date the bank receives your letter not the date you put on the letter or the date you posted it. I think if you send them first class the legal definition of delivery is 2 working days after postage. (I sent my request recorded delivery)Just to remember you to factor this delay in.
    My BoS statements arrived in 2 batches with 10 days to spare with regards to the 40 day limit. Not bad considering it's holiday season.

    " thanks recent enquiry etc......
    I regret to advise that having fully considered your request we are unable to make a refund of the charges....
    I advise that under terms and conditions of the account HBoS can levy charges when there are insufficient funds in the account to cover items.. entering into a legally binding contract with us......no error on part of HBoS.
    ....any more information contact above customer service team...."

    Do I go to the next stage of small claims court letter?
    Advicer appreciated.

    Just move on to the next stage of going to court.
  • Thanks for help . Truth be told recieved two letters from BoS.
    1 as stated above dated 21/12 from Edinburgh, then another the next day from Dunfermline saying that customer relations saying they will answer within four weeks.
    Maybe send a letter of action to both?
  • I would certainly copy in the Dunfermline address too but don't respond to the bit where they are effectively asking for four weeks grace.
  • Hi everyone, just looking for a bit oif guidance

    Sent my initial letter to hbos on 20/11 from the template requesting info on my current and visa accounts.

    Got letter back postmarked and dated 6/12 ref my current account acknowledging my reequest and stating that under DPA i would receive a response by 2/1/07

    TO date I have only received my Visa statements but not my current account ones.

    Just called the main 203040 Halifax phone number to see where they are and they say they dont have any info on my request, cannot transfer me to the Carlton Street Data Subject Access Request Team and that as these are copies of statement they dont fall under the 40 days dpa disclosure - this only applies to original documents - who knows what she was on about!!

    Anyway, I told her to make a note on my account that I want these within 7 days otherwise a complaint to the info commissioner would be made, she said cannot guarantee 7 days, maybe 10, but again my request does not fall into dpa regulations.

    Where should I go from here, sit and wiat 7 days, or re-write? Any templates or ideas to keep my application as watertight as possible? Thanks
  • Recently received an offer from FDirect but in the same post received a letter from Halifax stating that i have no claim and have not been mis charged, they mention that in their terms and conditions you must have enough money in your account to avoid going overdrawn.
    I have checked through my statements and worked out that they have charged me over £800 in charges over the past few years. Could someone advise if this is correct. The letter received just seemed to be a standard letter with a photocopy signature and this was sent from Head Office.

    I'm not sure which letter you sent but just follow the steps in Martin's article and send the next letter.

    Endinburghglass, wonder if you could give me any further info.

    I sent a letter away regarding reclaiming my charges from all 3 of my BOS accounts. This was on the 18th of december.

    I recieved 2 letters on the 1st.

    1 from credit card services stating:

    Dear Mr Brown

    Ref bla bla bla

    Thank you for your recent communication regarding the aboce numbered account.

    In relation to the recent statement issued by the Office of Fair-Trading, Halifax has agreed to reduce their credit card fees to £12. This took effect as of 1st of August.

    The fees you were charged were in line with the terms and conditions of your account and in view of this, we will not be refunding an charges applied. Up untill 1st of August, existing terms and conditions apply

    BLA BLA BLA

    And the other one for my 2 bank accounts stated

    Thank you for your letter, recieved at this office on the 18th of december.

    bla bla bla we will now take another 4 weeks for a manager to look at this.


    What do you recon should be my next course of action.

    Court action for credit card and wait for bank accounts?

    Or get on their back about the bank accounts as i gave them 14 days.
