Any help will be greatly appreciated. I wrote to the HBOS and yesterday received a brown envelope with only my last 2 and a half years bank statements in it. Why would they not have sent the last 6 years and what can i do about it?:mad:0

first try calling them and asking them whats going on. If you have used the data protection method explain to them that you dont believe this information is everything they hold on you and that you will be reporting them to the information comissioner, you'll probably find that they will soon get the rest in the post.0

You can't report them until the 40 day deadline is over. If you are still in this time limit, sit and wait. It's not unusual to receive your statements in seperate batches (I've seen this quite a few times).How many surrealists does it take to change a lightbulb?

After sending the second letter last week saying they had 7 days until I started court action, I have now received a letter offering a goodwill gesture of 1018.00GBP after my initial claim was for just under 1800GBP.
What should I do, fold my hand and cash in, or hold out for the lot?0 -

If you're happy with what's been offered, take it. If you want to pursue for the lot, you should get it, but it will take a bit longer.0 -
I have a couple of concerns before I embark on reclaiming my charges.
My position is this;
I worked for a large firm who sold up/ fragmented and went to pastures new, (every corner of the globe except Scotland.)
My company was so large then, they even had a branch of my bank on site. Bank of Scotland.B.O.S (so they would have known of the developments and situation)
Eventually I became surplus to requirements and lost my job. My bank was informed of this, yet the charges continued and the debts mounted. I buried my head in the sand as the stress of it all became intolerable.
That was until all the charges and debts were passed to a collection agency Blair Oliver & Scott.(B.O.S) who threatened via a telephone conversation to take my car if payments were not met (even though I owned my car out right and it was not in anyway part of the equation).
My overdraft went from £930 to £1400 and my visa from £2200 to £3300 within 6 months. These figures are excluding all the charges and extras I have endured over the past 5 years which I had also been paying. Which if I am correct probably reaches further £1000
My concerns are this can I recover my charges from my bank when the accounts are with creditors? (the debt collectors)
(Blair Oliver & Scott) and if so, does this mean that I can cease further payments to them as I am lodging a complaint of unfair charges, as amount I am paying at the moment is the charges!
And If the situation is resolved will/could my credit rating re-instated as the difficulties that put me here in the first place were out of my control? Namely the charges.
Further to this, the vindictive sods even made me pay a minimum of £50 pound a month for a year while I was only receiving unemployment benefits and looking for suitable work.This caused me no end of hardship and misery as I had a home to keep.
The amount in total now due is roughly £8000 -
Alright Folks,
Been looking into getting my charges back from HBOS.
I've followed the instructions so far(thanks folks) but I'm stuck.
Facts of my case are;
I have the last 6 years statements from BOS. Sent Freedom of information letter to Halifax, England to get Statements.
I no longer bank with Bank of Scotland.
I've calculated my charges to be £780 over 6 years. (£1015 including 8% interest.)
I understand there is a 5 year rule in Scotland but 6 years in England for claiming back charges.
Where I'm stuck;
Where do I send the demand letter and who do I address it to? (Seeing as I no longer have a local branch)
As far as I can see it would be better for me to go after HBOS in England to get 6 years instead of 5 refunded. Is this correct?
Is it easy for a Scot to chase banks in an English court. Is it worth it for me to set up addresses etc?
Hopefully there is someone out there who has been through this. Cos I aint getting nowhere!

got full statements from RBS so just sent off LBA letter today
Only got half of my statements from BOS so awaiting the others. Cause i requested this at the start does the 40 days still apply as i phoned them yesterday to request the others? 40 days expire on 8th jan 07
Got letter back from clydesdale bank saying they need account number and sort code so sent that off today. Does the 40 days still apply from the 1st letter?
Still no reply from capital one or capital bank ( part of BOS and halifax )
Most of them expire on 8th jan 07
what do i do if they havent sent me anything by then as am away on tuesday next week for 2 weeks so wont beable to check my mail.
Can i only claim for one account at a time from one company or can i put a claim in for a few accounts all in same claim?
any advice would be good.0
