  • i have been with the bank of scotland for 12 years,
    i have a mortgage , a bank loan and an overdraft with them.

    has any one claimed against them and had there account closed?
    i feel as though they have got me by the goolys.

    any feedback would be great

  • Hi everyone and thank you for all the help that's been given up to now.

    I sent my initial letter on December 7th asking for details of all the charges over the last six years, I found out later it could be five as I live in Scotland.

    Received a reply last week stating it was being dealt with.

    Today received a very thick envelope with past statements but they only go back to May 2004 which is approx 2yrs 9mths worth of transactions.

    Has anyone else had their statements in two separate deliveries, should they all have came at the same time or are they just hoping I don't check the dates and accept the ones they sent as the lot?

    I have a total for the charges on these statements at £1700 and I'm sure the earlier statements will more than double this.

    Another question is my Visa card is also with Bank of Scotland but was paid directly by cash not through my account, would I have to claim the charges on that account separately?

    Help needed please, before I start phoning to complain about not getting details of all the charges and looking a right plonka

  • Its likely you will get them in batches so don't worry about them all as yet but give them a call and ask. The maximum reclaim in Scotland courts is £750 but you can put them in as several claims.

    Your credit card will be a separate claim.

    So far BOS have untill This tuesday to get back to me with an offer on ther bank accounts as they stated that they recieved my letter on the 18th of december asking for charges back and it would take them 4 weeks to get a manager to review this and get back to me.

    My credit card on the other hand looks like it might be a bit more difficult.

    i ran through everything on here and done the same as my current account, i then recieved a letter as you will be able to see above in red which stated that they will not be refunding my charges back.

    Topay i have now sent them the 4th letter threatening court action so i should some more info soon as i have stated 7 days for a reply so hopefully i can help you further with this one as not much info on BOS Credit Card reclaiming.

    Took advice in this section and joined CAG, not had time to browse it yet, will try to make time tomorrow.

    I will phone tomorrow to find out about the rest of my statements and wait for them to arrive.

    I started the attempt of reclaiming bank charges on the 1st of December so it was easier to keep track of a time scale. I am reclaiming from Bank of Scotland. Anyway they have put me to Halifax I have now sent three letters in little over a month. I just feel as though the bank is trying to buy as much time as possible rather than just paying up. First response was simply a thank you for posting your statements to us blah blah blah, second letter was we have achknowledged your complaint and will be in contact in no later than four weeks. Third letter recieved today, was pretty much the same as the second saying they will try to resolve before the 6th of Feb. Anyway my question is what now? Do i wait till the 6th? Or do I do as I said i would in the previous letter which was start court proceedings? Or should I send a letter warning that I am about to commence court proceedings? Any help would be great as I want to speed this process up faster than the bank is allowing. They seem to be dead set they are not going to move it along any faster. SPeaking to a kind customer service lady on the phone she explained allot of people are now trying to reclaim bank charges, espeically this time of year so I can expect to wait a while.
    Also im considering sending the final letter template that says I would accept a lower offer for example, I have requested bank pays me £1780 back not inc. interest. I am tempted to accept a lower amount of £1500 should I try this and see if it works? £280 loss for me isnt too bad. Any help at all would be great..........:confused:

    Hey man yeah i was aware of that but like you not until recently. Despite that im still gonna try my luck at the full wad lol so far iv asked for £1780 not including interest. But i think im going to send a letter saying i will accept a minimum offer of £1500. I just feel the bank is trying to buy as much time as possible in hope that I will go away and give up. But I dont give up especially when it concerns money :)
    Plus I want to buy a new guitar with the refunds :rotfl:
    Ne how, what kind of response have you had since were at the same stage? Have you phoned them at all? I did got a pleasent response but again I feel as though this was to sugarcoat things while the operator was on the phone lol. So far iv managed to claim back £300 of charges I accidently got over christmas just by phoning them (that figure not included in my above £1780). I just explained to them that the £300 charges were unfair because I had missed two direct debits as we got paid late from work and that caused all of it to snowball blah blah blah anyway result was £300 back. So im wondering perhaps if you give them a phone try and wind them round your finger a bit you might get some back then claim for the rest back as you are doing now?

    Yeah i had exactly the same reply hah. Well im sending my final letter tomorrow before I start with court action.
    One thing I have noticed is they do keep within the time frame for replys to my letters just not what I request they should do within the time frame (i.e Refund me :P )

    I'm in same boat as you guys. I'm at the LBA stage with Bank of Scotland and have asked for £1620 before interest £2030 with interest. LBA is going off registered post today to my old bank manager.
    I take it I would have to enter a summary cause claim and small claim for this figure. I'm gonna try go the whole hog as that £400 interest would certainly be nice.

    Both my demand letters have went to my old branch.
    My question is If this new 14 days to reply to my LBA expires do I file the summary cause and small claim against the registered address of the Bank of Scotland? i.e. the Mound Edinburgh? Even although I have had no contact with them so far.

    Think this is the correct way of going about this, just need some reassurance I'm doing the correct thing!
  • I sent my first letter for details of my charges on the 7th Dec 2006.

    Last week I received about two and a half years worth of statements, still waiting on the rest.
    I haven't been in contact with the Bank of Scotland yet to see what has happened to the rest, will call them on Monday, but there is only three days to go until the 40 days expire.

    Am I right in counting the days or should I add days for the holiday period.

    Don't get me wrong, I have no intention of settling for two and a half years of charges and if I think I have a chance of collecting interest as well I will go right to the wire on this.

    Do I contact anyone on the 40th day, advice please.
