The man did get taken into custody yesterday - on what grounds I'm not so sure as I've heard nothing more. But the pictures on the dropbox link, (the first 10/20 anyway) are definitely of the taxi driver. As a taxi driver, he has a duty to hand in to the local police force if something is found in his taxi - he was employed by the council. The proof is in the pudding? If you don't hand it in, it's theft? excuse me if I'm wrong.
There is an offence known as 'theft by finding' which may apply here.
(The proof isn't in the pudding, it's in the eating.)

no but you can make the phone ring or make noise and light up and its close enough to notice that in most cases.0 -
A taxi driver who finds property in his taxi and assumes the rights of the owner and uses it as his own property, would have a difficult time persuading any jury he hasn't stolen the property. He must have known it was the property of a passenger and has a duty to hand it in to the police or take all reasonable steps to find the owner.0

Not to mention there's clear evidence it was used after it was 'found'0 -

Another update today.
The police have e-mailed me saying that the taxi driver who has taken my phone and politely shipped it to a family member in pakistan due to the IMEI being blocked......has been found to of had over 11 phones at his disposal, several of which have been logged as stolen (via IMEI verification) through phoning the police. Looks like I've got them a good one here. Not theft though? Looks like he is a bigger thief than I initally thought. Bravo to Google/Samsung/MSE users.......Who are you to judge the life I live? I know I'm not perfect and don't live to be. But before you start pointing fingers - make sure your hands are clean. Bob Marley - Legend.0
