    You are going to have to grovel, but even then I am not sure the employer will be lenient. It's a serious misdemeanour
  • it's hard to explain without giving too much personal info on here. The sort of job it is we are out and about , not in the office. we often need to communicate with each other as usually text, call or message on facebook. As I already had a lot of collegues on my facebook I put us in a seperate group as i thought it would be an easier way to communicate.

    complete and utter balls up and mistake on my part as i'm now finding out.

    I don;t know if anyone else is being spoken to about it as i've been told not to disscuss it with anyone from work.

    I've taken the group down and removed all the members from my facebook too.
    'communicate' not slag them off surely!

    FB says this: Secret: Non-members can’t find these groups in searches or see anything about the group, including its name and member list. The name of the group will not display on the timelines of members. To join a secret group, you need to be added by a member of the group.

    - Like asked why make it private and why on each add people to your own page who you work with. Bad idea. Even if you do not talk to them directly they can see everything you post on other peoples pages (apart from the group if they are no memebers).

    After 4 months of employment your employer could just have a "it isn't working out" chat and there would be nothing you could do about it.

    Your only hope is that by going through an investigation and disciplinary that it is not just a charade to make an example of you to make a point to all other employees and that you may actually have a chance of keeping your job.
  • as the title said i've been suspended today on the grounds of gross misconduct.

    Been with the employer 4 months , probation was 3 months and i was signed off with no problems , bosses always happy with my work.

    In a nutshell i set up a 'secret' facebook group, only 16 members , all employees of the same company to disscuss work related matters. Group was set to maximum security settings so not searchible , visable etc. so anyone except the members of the group.

    It would appear that someone in the group has informed the employer and must have logged into it through theu account in the office so the employers could look at the posts.

    There was a bit of venting on there and one client was mentioned by their full name and another by their first name.

    the gross miscoduct is based on breach of confidentiality and code of conduct.

    I am back in next week for the actual disciplinary.

    i'm not in a union.

    I genuinely felt it wasn't a breach of confidentiality as it's secure as any other for of communication between staff ie text or e-mail as it was a private group. Any other comments were 'normal' moaning that goes on between any employees.

    What do you think my chnaces are of keeping my job?


    Seriously. I keep trying to formulate a response, but fail each time. Why, after you had been with the company for such a short time, did you think it was appropriate for you to set up any kind of group for workmates to discuss the business?

    This would be a very "dangerous" thing for someone with a degree of security within the company (i.e. and respected and trusted employee of a number of years. YEARS, not months), but for someone who is still wet behind the ears, in employee terms, this strikes me as employment suicide.

    The chances of keeping your job? Absolutely zero, I'm afraid. I will be even more speechless if you return to the forum after the disciplinary and say you've kept your job.

    Yes, but as it's work then you should use work comms to communicate - not personal ones.

    The only reason that I think they are taking you through a disciplinary is because they might have to take action with everyone else. They could just let you go with no explanation. And that they will probably use you as an example to the others.

  • What does your IT policy actually say? If your policy doesn't specifically ban any discussion on FB about work, I don't believe that they have grounds to dismiss. Even if they did, I think you have good grounds for a fight, due to the confidential nature of the group. (But I do feel worried that you have been there such a short time. If they want to get rid of you, they can).

    I feel that you set up a peer support group. If it had been on a telephone, would the employer have minded? You tried to support each other and help each other deal with the stresses of the job. Can you cite cases where this worked well, from the site or from the site plus other forms of communication?

    If I thought a FB page would be an easier way to communicate with my colleagues, I'd suggest it to my manager and see what they thought. Just a thought for the future ...

    OP has less than two years' service. The employer doesn't need grounds to dismiss.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
