I think its disgusting what he's done. Hope he gets a very long prison sentence. Years not months.The forest would be very silent if no birds sang except for the birds that sang the best0

I don't need to do anything regarding my medical records. I have been told that the Police contact the eye infirmary for details. I don't remember signing any consent forms at the Police station or eye infirmary so only hope they have been in touch. I do however need to update the PC dealing with it but I have tried for two weeks and still waiting for a call back.
I think the maximum sentence he will get will be 6 months and even then he will only serve half his sentence. I really don't know what to expect, somedays I think he will get sentenced and other days I think he will probably get a small fine.0 -
Please stop trying to analyse the evidence or assess what the court will take into account at trial. You are not allowed to know the rest of the evidence, or what he said to the police in interview, and will just second-guess yourself into a right state based on only a partial understanding of a) the law and b) the evidence.
As for sentence, again that is not something which any person can predict with confidence. Assault by beating is common assault, as I suspected. If convicted, in my opinion a fine is unlikely - more likely to be a community penalty or custodial sentence. However, this is entirely a matter for the court. Again, try not to get yourself into a state about this.
It's unorthodox, but in the absence of the Officer in the Case getting in touch, I'd be minded to contact your local CPS office (www.cps.gov.uk) and ask for them to give you the details of the Witness Care Unit or to get a message to the prosecutor in charge of the case (if there is one). The WCU is staffed by police / CPS employees and have the job of liaising with victims / witnesses during their court cases. They may be able to assist. The WCU can also assist with the special measures element.
Frankly I think it's bang out of order for the OIC to be so slow in responding to you; you shouldn't be put to this worry about updating them with relevant evidence in the case.0 -
I have just had a call from the officer dealing with the case. She was the one who interviewed him and she told me he had his hands on show all through the interview and had no injuries to his hands. So either he's been lucky or he had a glove on or something in his hand. He said 'no comment' to every question.
I explained I have permanent damage to my eye and asked if this would be classed as ABH as he has been charged with assault by beating. She said yes it would be classed as ABH so it is a good thing there will be a higher charge but obviously not a good thing about my eye. She is going to get in touch with the eye infirmary to get my notes to confirm it is permanent damage.
The officer is going to visit me one day next week and apply for special measures as she thinks it would be best for me to go via video link. As it is domestic violence and he is an ex partner she said there is a very high chance special measues will be granted.0 -

Can I just thank you all for replying and helping me with this ongoing case. If it was not for you lot I don't think I would have found out so quickly about visiting the court, special measures and possibly a higher charge of assault.
To be honest when it first happened I was quite shocked he had been charged with assault. For some reason I only expected a charge for criminal damage. The new officer dealing with the case explained to me that although he didn't use force on me with his hands, he used force by putting the window out which resulted in me bein injured so it is assault. She told me she went for the higher charge of assault by beating rather than criminal damage. I did wonder why he was only charged with one and not both. Looking at it now I really don't know why he wasn't charged with abh instead of assault by beating. I understand the police did not know if my vision would be permanently damaged however the glass shattered in my face causing cuts and an eye injury. It could have been much worse with it being glass and I have heard and read about less serious injuries where the defendant has been charged with abh. Had I not spoken up about possibly a higher charge then I think the police might have just kept the original charge so thank you all for guiding me through this, I really appreciate it. Just upset with myself for not involving police sooner regarding previous assaults and threats. I admit it was hard and still is but it may not have come to this if I reported him sooner.0 -

Yes, I believe so. Looking at it now and understanding the level of different assault charges I think ABH would have been the more appropriate charge, not assault by beating. I had cuts to my face, ears, and hands which drew alot of blood and also an eye injury which I knew from day one that it was going to be permanent - it just had to be confirmed from the Doctor not the Nurse who treated me.
It shouldn't have mattered if the eye injury was going to be permanent for it to be a higher charge, there was glass involved and it could have been a lot worse. He recklessly smashed my window shattering glass in my face. Also as explained above I have read and heard about far less injuries resulting in the defendant being charged with ABH.0
