I have spent the morning on the telephone to ACAS and written a strongly worded letter informing them of my intention to refer them to HM courts and tribunals for employment law breaches. Regardless of my pay they are in trouble for insisting that I work back those last 15/20 mins without pay as 1) they are not allowed to do tha and 2) it means I accrue 5 hours or so a month that are unpaid and means the hourly average fell Lowe the national minimum wage rate. They also should have told me I was not to be paid as expected, not giving me a date of when I'm likely to be paid, failiure in not providing information about what I'm due from march and not giving me that money now as it has nothing to do with this pay cycle. I've been told that regardless as to how difficult it is to arrange these things or alter them the law has still been flouted and I can still refer to a tribunal.
I have given them till Tuesday to get my money transferred and if not I will be reporting them. My letter was much better than what I've typed here but they will know I mean it.
The charity I spoke to said they are on iffy ground with this months pay but there is no reason, in eyes of the law, why I shouldn't have monies from March.
I will do it to, I will report to a tribunal because all through April they will see me sign out at 6.15/20.
Last month a couple of apprentices didn't get paid on the right day because there wasn't enough money in the account as some childcare fees hadn't been paid. She talks about 'submitting to the accountant' and its down to him to transfer the paperwork back then she can pay me.
If at the very least I hope my letter will wake them up and stop the remaining girls from having to work any extra time without pay.
DH is tryin for an advance on his wages to pay the afterschool club tomorrow for last month but honestly I'm worried, so mad and feeling so stupid for quitting when I hadn't been paid at all.0 -

Don't feel stupid FUDDLE, they treated you very badly and you just couldn't have returned to that place on the Monday, you'd have gone into meltdown and that would have been so bad for you and your health. I'm glad you have some secure and legal advice and if that doesn't get you a prompt response I'll be very surprised, you could always mention the papers locally if they are daft enough to argue the case, I'll bet they wouldn't relish the knowledge getting out into the public domain that they are so financially challenged due to non payment of fees to the point of not being able to pay thier wages bill, that and the tale of your treatment over the incident with the child with the fork would show them in extremely bad light, wouldn't it? Been busy last couple of days, been reading here and thinking I'll post later and now I've forgotten all the old posts sorry.
Kidcat - what a pavlova but well done for handling it all on your own. Be proud of yourself.
Fuddle - nothing much to add but sending a hug. Could you have a word with breakfast club - say you are waiting for wages owed that are being paid late through no fault of you own. Worth a try speaking with them, they may have discretion to extend the payment due date?
Had very positive couple of days and feeling great.:):):):):)
Did my voluntary session at school Tues and spent some of it making an under the sea role play area which the children loved. Got in really early before the nursery staff as DS8 had a school trip so DS6 and set everything up to surprise the staff and had a sneaky coffee. Then instead of coming home starving for lunch, ate a snack in the car with a coffee in my travel mug (courtesy of the school staff room again) and went to nearby supermarches, got home in time to unload shopping, put cold stuff away before school run.
Wednesday I had a breakfast meet up with people from my volunteer training and those from a parallel course (meet on a different day). It was the other course tutor's big birthday so an excuse for both groups to get to know each other. I didn't realise I knew the tutor from another course so hugs all round when we met.
Managed to met up with a best friend at the same venue for a cuppa first as she lives round the corner. We met at a community caf! which is brill, never been before but it has a lovely friendly feel and it very cheap compared to local coffee shops. Think it will be a regular haunt as its near the boys' school, shame its only open 2 days a week.
Then on to my 1st counselling skills course which was GREAT, really felt 'right'. The group seems a good bunch as is the tutor and a friend and a friend of a friend also joined. A side issue but a bonus was that I was able to pass on some info to 2 participants who have children who stammer - I always mention I stammer at the beginning of a group for both my sake and to help others feel comfortable talking with me.
New swim class for DS8 after school which went well, he was less anxious than usual at starting something new and I had to send in a member of staff into boys changing room to hurry him up as all the boys were giggling together for ages instead of getting changed.
Have been asking around for ages to try and get a 1-to-1 swimming instructor for DS6 to get him back into swimming (anyone remember swimmingpoolgate last year when DS6 had to "rescued" from the pool - 2 separate occasions in 2 different pools). Think I have struck gold, waiting for one of the instructors to contact me with a date/time to start DS6. These swim classes/instructors are in a different league to the old classes (council run) and a fraction of the price, well the one to ones will be pretty expensive but needs must.
Today boys' school is closed for polling so they came with me to vote then we went to a nearby park and we all went on the swings! Favourite banana pancakes for lunch. We have been gardening this afternoon, the garden is unkempt and boring. Still needs tons doing to tidy it up but we have made a good start. When its tidy we will do some planting. Never grown anything much other than a few flowering plants in pots so that's another challenge to embrace. The front garden in still in desperate need of tlc but one thing at a time.
Right better put away the mower etc, keen to do more but need to do some course work for tomorrow, cook tea etc. Will try and do a little more with boys after school tomorrow and over weekend.

Fuddle, I would put my mortgage on it all being down to their own cashflow problems. Years ago I was on the brink of opening a nursery and did all the cash projections for a business plan.
I realised why the staff are all on minimum wages; there was no way I could make it pay otherwise, and it was still very tight even when I did this. A lot of nurseries do go under. The premises I'd earmarked did become a nursery, they have done very well, but the owner worked without pay for the first couple of years, I know.Erma Bombeck, American writer: "If I had my life to live over again... I would have burned the pink candle, sculptured like a rose, that melted in storage." Don't keep things 'for best' - that day never comes. Use them and enjoy them now.0 -
