Medical records given without consent

Hi I'm new here and have a problem I hope someone can help me with.
I am just back from seeing my GP and while there he asked me if I had sorted things out with social services! ... we had a visit from social services 5 months ago as they had a referral from a person (wouldn't say who) but that it had come through as a "child protection' issue. they asked my us some questions - silly things really and then said that it is not a child protection issue as far as they are concerned and that they disagree with everything the referrer said! they then asked us if we wanted any support which would be on a voluntary basis - we said no as there were not any issues and we never heard from them again!
however, this morning, at the GP, he told me the 'referrer' has telephoned him 3 months before the visit from social services, asking for the children's medical records and he, over the telephone, gave him our kids medical details!
I am bloody furious - this is not a person who works in social services and he just gave the info to him over the phone because the guy said it was a child protection issue!!!!
this can't be legal surely?

Make a formal complaint to the practice.

You will find all relevant legislation and codes of practice here:

Was the referrer another medical practitioner?

I find it hard to believe a GP would be stupid enough to discuss personal medical information with some unknown person who phoned him up.

    So do l.

OP, have you been to hospital about something with yourself or your child 3-6 months ago? Come into contact with the police? Is your child at school?

You don't know who the referrer was so you might be jumping the gun. Your doctor is allowed to discuss things with certain people and l'd be surprised if he'd done things wrong.

    Happy moneysaving all.

No the referrer, although worked in the NHS/ local council was not a medical person. We had in fact had dealings with this person and complained about him when he verbally attacked our daughter - leaving her in tears! The referral to social services was completely made up and obviously retaliation because of our complaint.

My daughter had received some physio for a complaint she had last year, this man worked in the department and tried to pass himself off as a physiotherapist - he was not and my daughter complained and received verbal abuse from him.
I do know who the referrer is as my GP printed out the correspondence he had with the man and it names him!
We have never been involved with the police and my daughter is 15 years old and at school and is a gifted student! so there is nothing in her life that would merit a referral to social services.

Depends what sort of position they hold within the NHS....

File the complaint as tiddlywinks suggests. If the doctor was wrong then l hope you get things sorted and an apology.

ETA: Our posts crossed, l can see now you've updated your thread. File the complaint....

So what action was taken against him?

This man told my GP that my daughter was seeing him for physio. - (she is a gifted violinist and had pains in her upper back and neck) the GP had referred her to physio for treatment!
The man told my GP that he was my daughter'e custodian? whatever that means and that he had concerns and wanted her medical history.
I have telephoned the social worker that came out to see us and she said the referrer had included my daughter's medical history and school reports with the referral! so now the bloody school has been involved and handed over reports!!! cannot believe this:mad:
she confirmed that no action will be taken and has notified the referrer that no action will be taken.
    Its all so insidious.

I don't know if that man stepped out of line (it does sound like though) but you may also want to be complaining to the hospital where he works too....

OP - You are drip feeding the story which is not helping...

Could you just give all the relevant facts so that you can get a useful opinion from folks on here rather than just mentioning the odd bit in each of your replies.

    For instance:

Who exactly did the GP disclose information to?

In what format was the disclosure? Written or verbal?

What reason has your GP recorded for the disclosure?

What were the allegations relating to in regard to the disclosure?

Finally, are you saying that someone acted inappropriately with your underage daughter? What did you do about it at the time? What will you do about it now?

Basically, what are the facts and what do you want to know?
