    If you sent them the SAR letter then remind them that the SAR states that you require all your data. Remind them that failure to do so will mean a complaint to the Information Commissioners Office. Has it been 40 days yet?

    I sent the first letter in november, so it is 40 days since then.
    what really bothers me is that they are saying its their "final response" can they just do that?

    Its very strange that they are sending a final response when they haven't actually sent you your data. Re write them and tell them that you wrote in November with the statutory £10 charge asking specifically for the statements. Thank them for the compensation for failing to comply with your request but would they be so kind as to provide you with your information(give them 7 or 14 days--depends how generous you are really ;) ). If they fail to comply then complain to the Information Commissioners Office.
    We can deal with that 2006 argument that they seem to want to advise you on when they provide the details to you. Hope that helps a bit.

    so, even though they have said its their "final response" you still think its ok to send some thing along the lines of what you have said above?
    i thought it was really bad originally when they couldnt even send me a list of charges just a load of printed statemens - conviniently just since 2006 - so frustrating

    The post I made yesterday was a cheaky response to them. However, I will give you the link for complaining to the Information Commissioners Office about it. I think you need to remind them of their responsibilities under the data protection act.

    The 2006 argument is not based on law either so we will sort that out when they provide the information.

    Hi Kylle,

    Had exactly the same thing happened to me - received a credit for a much lower amount than what was claimed + a small interest refund.

    I have just checked my online balance today and seen this info. Is it standard for Bcard to send out a letter explaining the refund (which I can then respond to)?

    hi, this is a little similar to what is happening with me. they said all charges since 2006 were fair and as a gesture of goodwill they have credited £35 to my account:mad::mad:

    i didnt ask for this to be credited to my account and it certainly is not £35 more like 10 times that.

    i am just about to send off another letter thanks to the advice of natweststaffmember who knows what he is talking about. look out for his posts on this board he is probably better to advise than me.

  • I have received a full refund from Barclaycard for my friend. It takes a few letters. Even at the end they tried to short change us by £90 on the interest. So we complained to the Financial Ombudsman and they paid up the last £90 as well.

    so just to clarify, with a bit of chasing they are paying up the £12 charges as well, even if they are deemed 'fair'?
  • On a claim excluding interest Barclaycard first credited my account with the difference between £12 and the earlier £25 fees, I said 'Thanks but not enough, please pay the rest or will go to Ombudsman'. They then paid the rest +8% interest into my account. However they have cut my credit limit accordingly, not to big a deal as I am trying to get shot of all Credit cards.
    'Neither a lender nor a borrower be'
    Now why didn't I take any notice of the
    second part of that quote!!???
