I'm hoping someone can help me with a small question i have? I've read through the forums and I'm sure the answer is there however I can't find it, so here goes:
I tried claiming back £1058.41 from Cap One and received the usual response and had the difference paid back to me on all charges over £12. I now want to take them to court for the rest. My question is, is when I go through MCOL do they need a break down of charges and if so how do I show it when I have already had some back ? Do I just randomly take some of the charges off my list that amount to the £235 I've had back or do I claim it all? Hope this is clear enough for someone to help, Many thanks Saz0 -

Just give the charges amount, interest and the total of charges - you could put that you have accepted a partial payment of £?? but are claiming for the rest.
I personally left out the partial payment and the court sent me a form from the bank stating that they had paid half and do I want to continue - I do!
If you did go to court - very rare- then you would take your statements and breadowns with you then!

I was wondering if anyone could offer me any advice.
Capital One sent me a letter a while ago - at the end of May saying that they would offer me £32 out of the £80 of credit card charges they owe me.
I've been really busy with work and completly forgot about it till now but I wanted to decline and go for the full £80. I went to get the letter today and the person who wrote to me said that if I don't reply within 4 weeks they will consider the matter closed.
The frustrating thing is the banks allow themselves 40 working days, why do we the consumer get less time?
Anyway my question is do you think I am still within my rights to respond and decline the offer?

I would write apologising for the delay in replying due to pressure of work and inform them that you accept the £32 as part payment without prejudice however you will be continuing to pursue the remaining charges that you consider that you are owed.0

I have been chasing Capital One for bank charges and sent off for statements which arrived a week later. Calculated charges at £174 and interest and sent off letter reclaiming £240. Got letter today apologising for the inconvenience caused and saying they have refunded £66 (difference between what they charged and £12) to my a/c to reduce the outstanding balance! I rang them and told them the above story. They agreed that they were not chasing me for the balance and that the a/c was closed as far as they were concerned and that the £66 had indeed been deducted from the balance outstanding. explained there wasn't a balance as I'd paid NCO in Full and Final Settlement. They said no-It was in f&f to NCO but there was still a balance (although they weren't chasing me and the a/c is closed) therefore credit agencies such as Equifax would have it down as a partial settlement. Is it worth chasing this one any more? If I get all I asked for back it would still be £200 short of the balance they say is on the a/c and therefore will still show ona credit rating as "partial settlement". (Personally I thought these things were either settled or not settled-never heard of partial settlement)
Any thoughts would be welcomed.
The £12 is now used by the banks and credit companies as a justification to keep hold of your money! Capital One tried it on me but I refusedThey have now offered 100% of charges

Don't be fobbed off and if you threaten court then take it to court in your time scale not theirs and add interest
Also as I was not able to find anyone else's decent wording on how to reject a partial offer I thought you all might like these words

Im not sure how they do it.. I get the impression that they tell MCOL they are defending as they have paid up and around the same time you get the letter saying what they are offering you!
Fingers crossed I could really do with the money comin gthrough without taking the MCOL further. Im going on holiday soon too so dont want to have to come back and do a rush court bundle!!! the thought of that is scary!
How much are you claiming for if you dont mind me asking? Im now up to just over £1500 inc interest and mcol costs... for a £1000 claim they offered me just short of £400.
