Has anyone managed to claim successfully from Capital One via the FO?0

I was owed 350 in charges from Capital One - I wrote to them threatening legal action and they offered to reduce each charge to £12 and paid this money into my account. I told them this was not sufficient, and they said they would not pay any more. I issued a small claims action for the rest, and they wrote to me to say as a gesture of goodwill they would refund the rest!0

Just wanted to update you on my claim, I had a letter last friday saying that they would pay all of my money back after doing the mcol ,TODAY i have recieved my cheque.
So for all of you that feel like giveing up i felt like that now i am just over 1k better off.

So can someone explain this 21 day thing to me
about them paying up after 21 days. I've received no part payment or anything from them I filed MCOL on 11th Jully so is it 21 days from then they should pay me ? And are Cap One paying cq not crediting the account ?

Its free and its available - so why not give it a try. If enough people use the FO the banks wont take as long to pay up as they dont want £400 bills every time a complaint is to be investigated. Good luck.0 -

Similar story here - they sent me a cheque for the difference between £12 and what I'd been charged, but I pressed on with court action and soon got the rest back (got the second cheque around two weeks ago). Wish HSBC would do the same - it looks like they are making me take it all the way :mad:0 -

OK you should get your statements within 40 days, only if they go beyond this can you call in the Information Commissioner at www.ICO.gov.uk you'll then get them in under 2 weeks.
Capital One offer a really low amount being your charges less £12 per charge as this figure was requested by the Office of Fair Trading as a more appropriate charge value - DON'T PANIC & DON'T ACCEPT it either, its still far to high a charge.

Cap 1 were the most prompt in sending statemetns .Only a few weeks. Just delay afterwards.0 -

I was just wondering that you say 'once you've started with the court claim' and your letter adds a self litigation fee.. but if you have already filed the details and amounts with the court isn't too late to add the self lit fee onto it?? I would have thought that the mycol part is 'fixed in stone' and that the amount can't be changed??
I've just started the Cap One on Mycol.
I was thinking of sending a copy of your letter for my RBS credit card claim and adding this self lit fee to it - I'm too skint this month and will have to wait until pay day in two weeks to start but could use the time to send another LBA with this fee added or do you think that adding the self lit fee on mycol claim would be 'thrown out' so to speak???
As you can see I really don't know much about court stuff and wish I had years ago when a landlord ripped me off for £2,500! and the mold in the room gave me tonsilitis for 2.5 years! :mad: been a sicky person since!
