If you have managed to get Judgement by default and not Rejected then Cap1 will be contacted by the court, if you don't hear anything within 7 days there is another process on MCOL that allows you to move on to the next stage and get the court to get your money :) This incurs further costs to Cap1 so its in their interest to pay up :)

What I am trying to find out is, should I complete the warrant part of the MCOL at this point or only if I do not receive payment. Sorry I am being a bit dim. But having got this far I don't want to mess it up.

Technically you could go do it now but I would give them 7 days out of courtecy then go for it :)

This is great , I shall crib if I may.? I am claiming about the same and intend to start MCOL tonight. I have tried 3 or 4 letters now , more than I did with Nat West in attempts to negoitate Cap One just stone wall me with offer of £ 360 -and so to battle

Thats why I posted it up here! :) A lot of people don't feel comfortable writing letter and don't know where to start or what to say. This was my 7th letter to them (including initial request for statements) and you need to have started the MCOL process really to use the exact wording (mind the typo 'Your' not 'You' 1st word 2nd para), otherwise point out that if you have to take it to court it will incur court cost (these vary with size of claim) etc.

The keen eyed readers will notice the change in value on my interest calculation between the letter and the statement which is due to the statement being calculated and printed a couple of days later :)

I sent a similair letter advising 'Ellie' (Renshaw ? If so same one as me :) ) of all costs applicable to enforced recovery action in the absence of forthcoming lawful resolution. In mine I mentioned a Wasted Costs Order to the value of £320 though. Full info and details on applying for this kind of order here for anyone who is interested:

    Wasted Costs Order

I dont think they are too bothered about the costs though. With interest and costs and a Wasted Costs Order (if applied for) it more than doubles my claim of £650 to £1368. It is ridiculous that Capital One employ such wasteful staff who are consistently losing the company money like this.

My mention of the 'Self Litigation Fee' was a way of getting them to hear me :) I had no intention claiming it unless it got to court but I don't think any bank wants to get that far especially in view of what Yorkshire Bank have been asked for in Hull ;)

Capital One are not alone in their bad management of the situation but until people stop accepting the low offers and stand up to the banks then they will continue to try to get us to accept the low offers.

Its off to MCOL for the remaining £405 now, just as soon as the ex gives me my half of the refund and his half of the court costs ;)

    *sigh*

For some very very odd and completely unknown reason his credit card isnt recognised in any ATM machines and he cannot withdraw the partial refund we received. How utterly inexplicable.

    Hi All

My claim was served 1st July,Acknowledged 3rd July.

Does this mean that I MIGHT get a letter soon on the 21st to say they will be paying me in 14 Days?
