I SENT THIS LETTER LAST WEEK
I refer to default charges applied to my account amounting to £XXX, which i requested you pay back
I wrote to you on DD/MM/YY making the original request for a payment in settlement of my claim. I will accept without prejudice the offer of £XXX but am writing to inform you that I intend to claim the full amount claimed together with interest up to the date of judgement and court fees in the proceeding through the county court
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfaie and not proportionate to your costs, and therefore the court will rule in my favour,
I have attached a full schedule of the charges with this document.
I look forward to a full response to this letter within 14 days, otherwise I will commece court proceedings to claim my money

They always hold out till the very last - so make your mind up early whether you intend to take the FO route ot the court route. Once they send their letter offering their measley difference between £12 and £20 that is their final offer. You then need to take it further, but once you have that letter you can take it to the FO. It costs the bank £400 every time the FO decide to take on your case and do an investigation. No company likes to be investigated and therefore tends to make an offer at this stage. Good luck!0

Have filed my MCOL today against ignorant capital one, i've gone through all the letters requesting my money back and had no offer nothing from them. I'll see how I get on

In our case they waited till the last possible moment, pressed the Defence button then send us a letter saying we will send you a cheque for the full amount within 14 days and have defended the claim on the basis that we have paid you. Bit cheeky as they hadn't actually sent payment yet, but it did arrive within 14 days, which is when we cancelled the court claim.Reclaimed thanks to this site:

I have just received a letter from Capital One confirming they are going to refund all my charges with interest and MCOL Fee, as I have no balance they are sending me a cheque.
I followed Martin's guide to the letter, got the usual offer of the difference between £20 old charge and new charge which i declined. Filled out my MCOL application which was acknowledged on 22 June. Letter was dated 4 July...so hang in there guys its worth it
£416 back which is going against paying off other cards and my pursuit of refunds from MBNA (x3) and Nat West (x2).
My one question though and I think I know the answer - should I wait until I have the cheque before cancelling the MCOL ???0 -

I wonder if someone can help me? I have had a letter of the court this morning saying that cap1 have paid up and do i wish to end the claim basically in as many words BUT i still havent recieved my cheque , i recieved the letter of cap1 saying they wasnt admitting liabilty but we will pay you your money in 10 days i got that letter last friday.
What do i do about the court?

I made a claim to Capital One for £479, this included interest. They have sent me a letter this morning saying they have now lowered their charges to £12 late payment fee and they are willing to refund me the difference of the £20's that I've paid. They have credited my account with £122. What should I do now? I dont really want to accept these charges but dont see how I can send them the next template letter. HELP PLEASE SOMEONE?0
