Hi all,
Just wanted to share the content of my discussion with paypal just this afternoon regarding this hamper gate.
I had received two hampers on Christmas Eve which were not as requested and were also too late for gifts. Anyway, given the large scale problems, i was worried and filed a paypal claim. Today I called paypal and they said that their buyer protection in terms of 'Significantly not as described 'do not apply to these goods since these are perishable goods. However they would restrict seller account if there are large scale complaints. They feel that the card companies are better able to deal with this.
Any thoughts folks as to what to do now?
Well, will call up card company to get their response.:(0 -

I would suspect his PayPal account is already restricted with the volume of chargebacks already. I think it's when it hits around £500 this happens. I was out of the 45 day rule, but I have raised it as a formal complaint with PayPal on the grounds that they will be able to see the scale of this due to the number of people filing for refunds and also the fact that when paying for an item in aug/sept etc the customers could not foresee or have known that the seller would not fulfil the order so the 45 day rule is unfair on the customer in this case. I am awaiting a reply24 beers in a case - 24 hours in a day. Coincidence? :beer:0 -

exactly the same here but my 24 hampers were ordered on 23rd (2 to arrive each month). I was out for 20 minutes this morning and UK Mail delivered hampers which were despatched on christmas eve. I am so livid about it all. I had chosen a cheese and christmas one I got two cheese ones which is not what I ordered plus I wanted them for the first week in december NOT december 27th!! none of the messages were on the hampers either so the others i want for later in the year are a no go as i cannot have substandard or completely different items sent weeks late to family members and then not even have a message on them. Do I now send them back at my own expense as what I ordered was not what I got plus not sent in time for christmas plus i cancelled my order days ago and i have filed in dispute/claim with paypal which once it reaches 30th december they step in?
This is definitely the worst company i have ever had to deal with :mad: and I am just getting really really angry as I just want my money back so I can order the birthday presents I need in Jan from somewhere else etc etc0 -

It says to go into resolution centre dispute transaction and can dispute on the grounds of item not received or significantly not as described. The first one is for no item received full stop. The second one covers if say you ordered 3 items and only got 2 so ideal for those who have had part orders. Hope this helps some of you xx24 beers in a case - 24 hours in a day. Coincidence? :beer:0

The bank interest on all our payments added together could be a significant amount. Some of us paid back in August, so NHCo have had a lot of monies through August - December. That could be 5 months interest, in a business account, either sitting there gaining interest or being used to further profits. Just a thought.0

That's useful info, although when I disputed mine it just deleted automatically as it was outside of the 45 day, did they give info on how to get round that?

Norfolk County Council Trading Standards continues to monitor the comments of consumers made using our Facebook page and do appreciate the disappointment associated with this situation.
Before the Christmas break the priority of the service was to do all that was possible to ensure the business continued to make efforts to get deliveries made.
However further investigations into the circumstances surrounding the failure to make deliveries and having supplied hampers containing goods consumers had not ordered will take place in the New Year.
In order for officers to investigate this matter thoroughly it is important that consumers report their complaints to the Citizens Advice Consumer Helpline on 08454 04 05 06 or via the online reporting form.0 -
