TV Licence - misleading and confusing

    to use 500mb takes some doing on a mobile, most of my usage is wifi which doesn't come of the usage so I hardly use any, the odd email, the odd internet search when outside but that's no where near 500mb, I needed it tho as the iphone accesses the web everyday for updating stuff, so can cost a load if you don't have some monthly allowance.

    Oops, laptop got its knickers in a twist there and I had to close it down, think I was trying to make it do too much at once!!

    Thanks, I'll have a look into that, it would be useful for checking emails when I'm away. I would have to get the phone unlocked too, building up a bill here - ha ha - screen fixed, unlocking, £10
    top up, presume I would have to pay for a T-mobile sim too!!
    I have another old phone, I think that can access the Internet enough to be able to access my Yahoo account, that one is already unlocked.

    If you were to watch TV on your mobile, wouldn't it only be a crime if the premises you were in at the time didn't have a license? How does that work if you are in the street? Would you have to be covered by your home license?
    That could also apply to a laptop being used outside the home. The rule is if its got its own battery source, it would be covered outside by the home license- if you haven't got one at home, I suppose its not covered unless you were in a building that had a licence. They'd have a hard job to catch you though if you were outside on the stret and refused to give them your name and address!!

    After reading loads on this and reading the The Communications (Television Licensing) Regulations 2004, I have come to the conclusion that just having the equipment is enough to have to have a licence. if it is set up to receive a live feed.

    my reasoning is based on these references

    this is a copy of a warrant which states the equitment is to be "tested"

    this is a link to the 2004 act which states

    “television receiver” means any apparatus installed or used for the purpose of receiving (whether by means of wireless telegraphy or otherwise) any television programme service, whether or not it is installed or used for any other purpose.

    which in my case, I could not use my freesat box to only listen to the radio and watch iplayer as it can also be used to watch a live feed.

    My confusion came about by reading the info on the TV licencing site, which states a licence is not needed is you do not "watch" a live feed or record a live feed, which is different to what the act says, a court would be referencing the act not the TV licencing site.

    I guess I still need to pay for the bleep lience :mad:

    You are all correct on the basis of "installing & using a TV in order to receive live broadcast" then you will require a licence. However, I know many people who do, and haven't paid a licence for years.

    Many refuse simply due to paying for Sky and Virgin already who already pay the BBC in order to have their channel on their products. Others refuse due to the fact that it's a tax, or they don't watch BBC. Others refuse due to the recent Jimmy Savile/BBC cover up and don't want to fund a corrupt corporation.

    The communications Act 2003, is what it is - An act, legislation passed in parliament. Many people are refusing to pay their TV licence, mainly due to this act. There is NO authority for administrative courts in this country and NO Act can be passed to legitimize them because of the constitutional restraints. Couple that with the fact that the BBC have been receiving funding from the EU in recent years going against this country's, as well as their own charter provisions.

    Going back to the "act". People have been questioning under what "LAW" do they have to pay a TV licence, and that is why many have went years without paying it..

    The masses however fall for the propaganda and continue paying the licence fee. Those who don't however are bombarded with harassment and bully sales tactics from Capita sales men (hired by the BBC) to tell all kinds of lies on your door step, to install fear and do enough to earn their £20 commission fee by either 1) selling you a licence or 2) using what information you give them in an attempt to incriminate you by filling out all of their form they have. Under a Magistrates court, they will typically issue a fine. A fine being the current licence fee, so you are literally paying for a licence. Anyone taking it higher to a court of appeal or high court, they tend to come away without paying anything

    Furthermore, to promise a fine value is also illegal, and if people know the law, they can indeed escape the grips of the TV licence, and other fines (IE: parking tickets etc.) LAWS state that all grants and promise of fines and forfeiters of particular person before conviction, are illegal and void. This is because only the courts can make that call. No single authority or private company can do so

    I went ahead and cancelled my DD, and filled out the form online stating I no longer watched live broadcasts and requesting a refund. I then saw that you have to print out, sign, then send the form. My printer is on the blink so I just left it

    I then got a letter from them saying why have you cancelled your DD - please ring this number.....I did so, and the woman was great and really matter of fact - she said that as long as I didn't watch live broadcasts on my TV, phone, computer or other device, then I didn't need a licence and she would mark my accountr as such and send me a form for the refund. I even asked her if I could use one of the BT youview boxes that allow you to watch catch up TV on your TV and also scroll back and watch all TV from the last seven days without a licence and she said yes, that was fine, and I wouldn't need a licence.

    She did say that they may send someone round to check - How they would check I do not know, and in any case, I wouldn't let them in.

    Time has moved on (much quicker than it used to - or so it seems at my age) and my previous advice on residential telephony has been or is now gradually being overtaken by changes in the retail market. Hence, I have now deleted links to my previous 'pearls of wisdom'. I sincerely hope they helped save some of you money.

    This is interesting. I'd love to know if they could inspect me as they'd have to get through the key coded security gates, through the front door of my flat (if someone buzzed them in) before they even get up to my 3rd floor flat. I have a licence at the moment but rarely watch live TV now. Mostly Netflix or On Demand/Catch up services.
