  • I have been told I could claim back credit card charges but would this be wise as I am about to start a DMP?
    Would it be wiser to think about this once the card companies have agreed to CCCS plan, just in case it gets their backs up?

    Also bank charges? We are going to have to move to basic bank accounts so would it be a good idea to do those or wait until it is more finalised after the banks appeal?

    Hi guys,

    Long story short, I had a Loan and OD with Baclays which i've managed to clear...which totaled £8,500+ (After being defaulted), what remain are two credit cards, one with Barclaycard the other CapitalOne, both are defaulted. I'm into my 2nd year of my DMP with the CCC's and after clearing my debts with Barclays this June:j, £240 p/m is sent to my two remaining creditors.

    Barclaycard limit £1500
    Defaulted £2051
    Current Balance £1321

    CapitalOne Limit £2000
    Defaulted £2400
    Current Balance £1900

    Despite both companies knowing my financial difficulties they continued piling on their hefty charges (This was when I had contacted CCC's to freeze all interest and stop charges)

    I've tried to offer final settlement offers, but Barclaycard have been past onto a DCA, and would rather I paid them the £100+ each month....I also bet BC sold it to them for pennies:mad:

    CapitalOne first offered me £1700 to clear, I phoned again then it was £1400, not sure whether I should try again..........


    Is it worth writing to these companies asking for all my statements? I completely have no idea what to do?...I mean I could pay the 3ishk which is owing p/m but I still feel cheated with their charges....I mean they charged me an additional £900....Then there my bank account, even though the accounts have been closed are you still able to claim anything back?

    If you're getting charges on these cards you can reclaim them, they're not part of the test case.

    They would probably refund the difference between your charge and the £12.

    You can still claim from closed accounts, however, if it's a bank account you need to wait until the test case has completed.

    Charges were stopped when i entered into my DMP, which was last year. I guess I don't anything to loose from sending the first letter to Capital One and Barclaycard. As for the closed bank account, I wont be needing it as it was closed (Barclays), then i continued banking with my back-up bank Halifax and have done ever since.

    Me: I would like to offer you £500 to have my account settled in FULL and for you to notify credit reference agencies that the account is now settled and NOT partially settled.
    Creditor: Excuse me, £500?
    Me: Yes, I'm about to send a letter anyway requesting all bank charges dating back to 6 years, and pretty much estimated you added £500 inc interest in charges when I had defaulted, and I do intend to get these back
    Creditor: Cough, cough, Let me go speak to my manager......

    Worth a try huh:confused:

    my partner was in great financial difficulties and therefore enetered into an IVA process 2 years ago, would he be able to reclaim unfair bank and credit card charges??

    Decided to get the ball rolling and sent the first letter with a Cheque for £10 to Capital One and Barclaycard. Whilst i'm at it i've decided to claim what I can back from Barclays also, the account is already closed so i've got nothing to loose and most possibly ££ to gain:beer:

    I'll try and keep this thread up-date with my progress.

    Hi,

    My OH has a credit card that unfortunately is now on a DMP but they have still added interest on. I would like to request the interest and charges of around 1500 to put the debt back to where it was 5 months ago. OH cannot remember signing for the credit card can this give us some weight in requesting charges etc back?

    what steps do i need to take?

    You can put in a claim to the CC for the charges but not the interest as they are not obliged to freeze the interest. Start the claim direct to the cc using Martin's templates from the article.
