You can ask for a cheque but be aware that its likely that any bank or credit card company will put any monies claimed towards any debt held which will of course reduce the amount of monies owed.

    Hi Kevin,
im surprised you still banking with the same bank you owe money to with your IVA! Apparently my understanding was that if this bank is included within your list of creditors then any interest/outstanding balance is frozen. It might be worthwhile looking into closing this account and maybe opening a post office account, or try other banks you dont owe money too for your banking, even if it is a basic account.

I too have been in my IVA a year but got advised to set up an account i dont owe money too before the IVA was finalised,so my monthly salary was safe.
Other than that keep contacting your insolvency practitioner to speak directly to your bank to try and resolve the matter.
Keep posted if you have any luck x
  • Hi

A few years back I got my self into debt and couldnt afford to pay the monthly payments accross 4 credit cards and two overdrafts I incurred countless charges for late payments and failed direct debits from my overdrafts being maxed. I had no choice but to seek help from a debt managemnet company which I now pay a monthly fee plus a fixed amount which they then divide up between my creditors. The majority of the creditors have now handed their case to debt collectors who collect the money from the debt management company. I am now into my third year of this.

My question is.. Am I still able to reclaim back the bank charges from these companies who have now negotiated a minimum monthly payment with my debt management company or is this just pushing my luck a little too far?

    Many thanks for any advice

    Brad

I'm being charged loads at the moment from various cards etc as I am paying token payments (cccs) with a view to going on a dmp asap. These charges are my fault - can I reclaim them or would it be rocking the boat, especially as I'm tied to these companies for a long tine and need their co-operation?

as far as i know you can claim but chances are the reclaimed cash will be added to your accounts. It still benefits you because it reduces the amount of money you have to pay back. My hubby is in a dmp with cccs and he has claimed his charges back. It will reduce his debt by £1000 if we get all of it. Good luck with your claim!

    Thanks!

I think I'll wait until I am in the DMP, when the charges should stop, and reclaim all that have accrued to add to accounts, some are £16 a month plus admin so across all my creditors its adding up quick!!

can we claim back our bank and credit card charges while paying off the debts and overdraft using a debt management plan?
  • can i reclaim charges and ppi even if im under free debt management or does this mean i cant?
  • Ihave recently had to move my loans and credit card bills and overdraft onto a debt management plan and one of the debts is my overdraft. In these circumstances, as I am negotiating a debt management plan (I am in month 2 of payments) can I still reclaim charges. HELP:j
