Me and my wife are currently in the process of setting up an IVA, and our main creditor is Lloyds, whom we owe £1800 outstanding balance from our current account, £8000 with their credit card, and a loan of £16000 with them.
We sent off our letter asking for our list of charges over the last 6 years from Lloyds and received a list back stating £2500 worth!! I then used the demand template letter from this site and stated that I wanted my case treating as a hardship case as our predicament is such that I think its fair enough to consider ourself as a hardship case.
I then received a letter back saying they were aware of our current financial situation (they've done their homework as our creditors meeting is booked for March 26th) and they would be contacting me within four weeks, without commiting to saying whether it will be dealt with now or not. I'm aware of the FSA waiver for hardship cases and have stated this to them, so am kind of in limbo at the mo.
It does raise of couple of questions though which I feel I'd only get the real answers from here
1-- Would my claim still be 'valid' as I'm about to enter into an IVA?
2--Will my claiming prejudice them as far as my creditors meeting goes?
3--Even if my claim is dealt with and they agree to pay, am I likely to see any of it or are they within their rights to keep it and deduct it from my debt to them?

I have been on a debt managment plan for nearly 12months now,is it possible to still claim back charges when you are in arrears,
- DMP started July 07 £25.000
- July 09 £18.000

Have a read of these previous posts but be aware any monies reclaimed will be put towards any debt held by the bank which will of course reduce the amount you are in debt.0

Does anyone know if I would get anywhere if I started a claim for bank charges on an account that was closed because I entered into an IVA?
I calculated last July that I had paid approximately £1,800 in bank fees to HSBC but never got round to claiming them because I was going through the process of entering into an IVA. At that time I had an overdraft with them of £1,700.
If I started the process of reclaiming bank charges, and assuming it was successful, does anyone know if I would be presented with the amount reclaimable, or whether the balance would just be absorbed into my IVA?

Can i claim back the charges from the 2 credit card companies that I have included on my DMP??? It would really help reduce what i am paying them.
Also, is there a way i can find out if I did take out PPI on loans as I think I did but not totally sure and have no paperwork going back that far to check??

Does anyone know if you can reclaim your charges if you are in a debt management plan and the debt has been passed to a debt collection agency? If so do you contact the card issuer or the debt collection agency?
Have massive debts and anything reclaimed would be a big help to pay off debts!0 -
Im glad someone brought this up, im with the cccs and have applied to lloyds before going on the dmp. im due £2600 in charges from lloyds but im in arrears on my rent etc so i want to use the charges money(if i ever get them) so settle rent arrears(naturally) before i get evicted. Will lloyds if they ever pay up refund this to the account i had with them as there is a £750 charge on this, which i refuse to pay as i only went £10 overdrawn with them. Or can i be cheeky and ask for a cheque???0

Does anyone know if its possible to claim back from the creditors that are involved in my IVA? Bank charges nd credit card charges are half the reason im in this mess! I think if i come into money anything over the £500 mark goes to the IVA company, which means paying off earlier anyway, but should mean i can keep the first £500? Correct if im wrong please, im not 100% sure.0

Hopefully someone can offer some advice here as its a bit of a confusing one!
Basically my boyfriend got in some money problems previously both when he had an individual account and when he held a joint account with his now ex wife. The accounts have all been closed due to taking out a trust deed (same as an IVA really). He doesnt have any past statements or anything and is also virtually divorced. Now my questions are:
1. Does it being a closed account or the fact he owes money through an IVA-type of agreement matter as to whether he can claim charges
2. Can he request past statements if the account is closed?
3. Does this matter that some of the money was in a joint account?
Im not sure who else to ask these questions to so hopefully someone can offer some advice on some or all of these points as lots of charges were incurred in that period.0 -
You need to start your claim with the bank/cc that your account was with however be aware that any monies reclaimed will go towards any debt no matter who now holds the debt. This of course will reduce the amount of debt so all to the good.
It doesn't matter if the account is closed you can still ask for the statements as normal.0
