  • :cool: :cool: I have had a Debt Management Plan with the Nat West, and First Direct for the last 2 years, but i am owed probobly a good few hundred pounds in Fee overcharges.
    Can anyone advise if it is prudent or possible if i can still reclaim my fees on these accounts?
    I do not bank with either of them now, so they can not close my accounts.
    Any help would be greatly appreciated :cool: :cool:
  • Having looked at all the info on this thread I have decided nothing ventured nothing gained and i am going to attempt to claim back bank/credit charges . If I get anything then I will of course be repaying it towards my huge debts. If anyone has successfully claimed anything abck while in DMP it would be good to know.
  • Does anybody know the rules.
    I was forced to take out an IVA after nearly a year of going overdrawn due to a mistake from the bank and a loan i took out.
    I got a loan of £X and they were £600 short in the end amount. They decided to increase my overdraft to make up the difference.
    I thought this was ok. (stupidly) The problems then started I would go overdrawn every month but as my overdraft was £1000 it wasnt a major problem. They would though charge me every month but I always ended up paying it off just as my wages went in.

    Can I claim charges back from the bank, as I am in an IVA. I am not with them anymore.
  • HI CAN ANYONE SUGGEST WHAT TO DO AS I AM IN DEBT MANAGEMENT AND HAVE BEEN FOR THREE YEARS AND I NOW WANT TO CLAIM FOR THE BANK CHARGES OVER THE LAST SIX YEARS.

    I DO NOT WANT TO JEOPORDISE THE CURRENT SITUATION WITH THE BANKS AS EVERY SO OFTEN THEY OFFER A REDUCED AMOUNT FOR FULL STTLEMENT.

    THEY ALSO KEEP THE DEBTS ON 0% INTEREST WHICH ALTOGETHER MAKES A GOOD OPTION.

    DOES ANYONE THINK THAT IF BY PUTTING IN A CLAIM THAT THIS WILL ROCK THE BOAT WITH THE CURRENT ARRANGEMENT?

    Hi there I Seem to be looking for the same as a lot of you? I'm in the first 4 months of my DMP with Payplan, and the two nastys who are not playing fair are my bank NWBS. They are currently progressing via court for CCJs I Presume. Can I still progress the Bank Charge reclaims while this is ongoing, the amount I would get would probably pay them back which would be heaven!! Nice to know there are so many people out there who are feeling the same as me?

    Can anyone advise, if you have a DMP and have A CCj via the bank which covers off your OD, can you still progress a claim??

    Wouldnt that be great if you could, I could pay them off then! With the money they have charged me over the years

    Hi after a reducion in tax credits and living beyond our means we missed repayments and started a low dmp with the cccs they have sent an agreement to lloyds tsb with repayment details for our loan (remaining amount around £6,800 and our 2K overdraft which thanks to charges stands more at £2,700). CCCS have sent the info 4 times but lloyds are saying they have not recieved anything from them so have been putting more and more charges onto both my loan and bank account as an agreement wasn't in place. Around 2 weeks ago I was on the phone to the bank who said as they had recieved a payment from cccs off the overdraft that all interest for that account was being stopped but as they had not recieved any payment to the loan I would still get charges now in a phonecall this morning I have been told a charge of £180 was being put onto my overdraft account and that they told me in error the charges had stopped during my last phonecall. I am not wanting to get back anything I can from them am I in a position to reclaim charges. Thanks guys PP

  • Hi - If anyone can answer my questions I would be eternally gratefull.
    I am really excited at the prospect of re-claiming my bank charges - must be a fortune I've paid over the last 6 years... but I fear my bubble may be burst as both the banks are included in my IVA and are closed accounts. My questions are:

    Will they even look at my re-claim application given my IVA with them?

    If they do look and I am eligible for re-payment will the just keep it towards the debt or send me the money?

    If they award me money and keep it towards the debt will this be taken into account with my IP and will the debt registered against that bank be reduced in my IVA, I have heard that in the final year my IP can make me sell any valuable assetts (or re-mortgage) to clear the final sum still owing - I am hoping that if I am awarded but it is withheld, at least it will reduce my final IVA figure still owing in year 5.
    I am also in the same position with a credit card via a bank...

    Hi,
    cant help with bank side, but if your struggling to pay bills etc tax credits have the ability to often pay you additional payments - this is on top of you entitlment so will cause an overpayment which you will have to pay back - but might be enough to buy you some time???

  • I was wondering if anyone knew if it would be possible to try to reclaim bank charges from a bank I no longer hold an account with? We used to bank with A&L and had an O/D limit of £1k. We were really struggling financially and in the end the O/D ended up nearer £2k simply due to all the charges (yes, they added on excess charges of nearly £1k in less than 12 months!). Things came to a head in 2005 when we went on a DMP with the CCCS and opened a new cash account elsewhere so A/L became a creditor with the O/D. In the end we sold the house and successfully completed a lump sum IVA in January this year. The bank account with A/L as far as I know was closed when settlement was received from the IVA but I was wondering what the view is on whether it would still be possible (or appropriate?) to be able to claim for all the charges they made which certainly had a significant impact on our troubles.

    I would really appreciate hearing from anyone in a similar situation or anyone who has any knowledge of how this might be received. Thanks.
