  • Hi , could someone let me know if i can claim back all the charges that were given to me ,as there was thousands ,but i am now 3 years into the IVA ,COULD I STILL CLAIM IT BACK EVEN THOUGH I AM STILL PAYING MONEY I OWE TO THEM ,OR COULD THE MONEY I COULD CLAIM BACK THEN BE PUT INTO THE IVA FUND TO PAY IT OFF AND REDUCE MY MONTHLY PAYMENTS.

  • Can I send in claim if I have recently actioned a debit management plan with CCCS ?
  • I would have thought that a firm like cccs would be helping you reduce your debts.

    I would put in a claim or if your unsure ask their advice first.
  • I currently owe Natwest a fair bit of money and am paying them off through a debt management plan (CCCS).

    My account with them is now closed/suspended and my question is am I still entitled to reclaim bank charges for the period I held the account.

    I am just really worried that if I claim then Natwest may turn around and demand the full amount owed to them!!!

    Help!!! It could be in excess of £1,000 and I could do with the money, even if it's offest against what I owe.

  • Yes you can claim but as you say the bank will probably put any monies reclaimed towards any debt but this of course will reduce the amount you owe. Have a read of the previous posts and you might also like to let CCCS know that you are putting in a claim.

    This is where you need to be carefull,and to be quite honest with you this should be put on the reclaiming guide.They debit the account with the refund.

    So if you are going to take people to court and you are in any debt management plan consider the amount you are reclaiming for.

    I for one am right cheesed off with fighting a claim and paying for papers which had no real benefit to me.The only winner here was the debit company.I am however chasing it up with halifax.

    I am new to this site, and not really sure if you will be able to give me advice.

    I got myself into a huge amount of debt £54000, and commenced a IVA in Aug 2003. Before this I was living in and over my overdraft since year 2000. Will I be eligible to claim these charges back to 2000?

    You can try getting a refund using the methods described in other threads.

    Try the Debt Free Wanabee forum for more general advice.

    OK , I am about to send out my letters for credit card and bank charges, can anyone tell me, seeing as i am on a dmp, if any of my charges are refunded ( i am claiming from 4 creditors) will i get a cheque or will they use the funds to reduce my debts automatically, obviously these accounts are basically dormant so i am not sure what will happen.
