  • I recieved a £60 charge and did not get the ticket they said was on my car .if i had recieved the ticket i would have contested it straight away as i was in sainsbury doing my weekly shop. Help

    It appears that TCP are not who they once were, or maybe not even the same company, from other TCP posts on here, and pepipoo it looks like someone has been passing data that they shouldnt

    Just to clarify, no dodgy passing of data/documents - well apart from one.
    The one i received from the scammers that i'd been hoping and waiting for.

    It looks as though all those redundancies in Perth since the Kiwis took over is starting to show through. It seems that so bad were things (including having what amounted to "ghost" staff and other bad practices) that the Chief Exec from the parent company in New Zealand had to come over to manage things - and is still here. The former T&CP MD, Bernie, departed very suddenly in September.

    Keeping at least one foot on the floor it appears that there has been an admin foul-up and the wrong company number has been quoted. The original T&CP Ltd (formed in 1992) changed its name on 3/12/2012 to Smart Parking Ltd and so it remains the same legal entity. A new company called Town & City Parking Ltd was formed on the same day and is an entirely separate legal entity.

    As far as any contract with Asda is concerned it would not be unusual for such documents to incorporate (or to specifically exclude) a phrase referring to "successors or assigns" and from this point of view would include Smart Parking Ltd - who, as set out above - are the same legal entity in any event.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    It will depend on exactly what the Assign clause states though. It may require 'written consent from both parties' (which is the common one). Although knowing a PPC it probably doesn't. Again, not good due diligence to sign up to such a term but how many times have we seen that before in PPC world?

    Far better explained than my stab at it. As you so rightly point out due diligence and PPC's are not terms that appear in the same sentence with any regularity. As Somerfield so expensively discovered recently.

    The name change isn't the problem, it's the new names, companies and using the old name on correspondence that is.
