    Thanks guys for your quick responses.

    I'd better explain what happened properly so it makes sense!

    The overdraft debt i owe abbey (£436.60) was passed to a DCA, i phoned ages ago and told them that i cant make any payments as i am in dispute with abbey right now. So they said they would pass the debt back to abbey.
    After writing the letter which stated that they had 7 days to pay up, ichecked my account balance over the phone and was told it was at nil balance, so by the posts on here i thought they had given me a partial payment and just not informed me. When i got a letter through the post from a different DCA, i figured they had passed it back to a DCA again and i phoned them this time to tell them the same thing i told them months ago.
    After that, i filed a MOL claim and sent it off.
    Then i received the letter saying that they will refund me £120 as a pitiful GOGW, but i had already made the claim! and havent deducted the £120 from the amount.
    Today i have received the letter saying they want the charges list and whatever..........feel a bit daft now, like i've cocked up.

    Would you suggest sending them what they are asking for PLUS the letter saying that i accept the GOGW as a partial payment without prejudice blah blah?

    Any advice guys would and IS greatly appreciated, nearly there now you see!!
    I can see the light at the end of the tunnel, am also planning to claim from a Capital one credit card and also £40 "admin fees" from GE Money!

    I've heard of a bank calling in the Debt Collectors for an overdraft, that person contacted the Debit Collectors and advised them that they're taking the Bank to court and are in the court process at the moment as they owe YOU money and this is their was of trying to get back at you, the DCA didn't want to get involved, so try that, it can't hurt!!

    have threatened "shabbey" with court and their fourteen days to reply passed on firday last week. Does anybody know the address i use for abbey for the online court form???

    Does anyone know what happens if you don't receive an AQ to complete? Only received Abbey's defence from the court but no AQ? :confused:
  • hi can anyone help me here.....i got all my statements...added up what i was owed and sent letter to abbey....they said it would take four weeks to look into the matter (which i gave them) only to get another letter saying it will be a further four weeks....i sent off my letter threatening court action, but unfortunately my baby was taken into hospital and i couldn't do anything (they didn't acknowledge receiving this letter tho)....however, a week ago they sent me another letter asking for more time and then three days later deposited just £1,000 into my account and sent me a letter saying the charges were fair....they owe me £5,000 plus interest...so i'm not willing to accept this amount...wat can i do now????? any help would be much appreciated.....cheers alabalafala

    They keep telling you it will take 4 weeks because they are stalling!! It took me 5 mins to work out my charges I can't imagine it taking Shabbey much longer, i'm sure there is a Shabbey button they can press to work out how much they've nicked off me. Anyway if you have already given them 'pay up or court within 14days' letter, then file a claim with moneyclaim. Also send them a letter RECORDED DELIVERY advising them that without prejudice you accept the £1000 and will still be claiming the rest of it through court.

    Can anyone tell me? If my AQ has to be in by Friday how long after this do I get to put together a court bundle and where can I find help in putting this together?
  • Hi, I've recently joined my partners Abbey bank account that she's had for the last 5 years. Over the 5 years we've been charged an obscene amount of money for going overdrawn probably near £3000, so as you can imagine we're very keen to claim it back.

    What i want to know is although the account has recently become a joint account (about 4 months ago) can we still claim as far back as 5 years (the account number didn't change)?

    Also, do i send the 1st letter to my branch or to Abbey's head office?

    And while I'm here i have to tell you what happened today. I received 7 letters, each one advising me of a £35 charge, all visa electron payments made on and after i got paid (£1500) on the 25th of March, i know the money was there because rather than check the often slow updating cash points for a balance we ring Abbey's automated service, and I'm never paid late anyway. The total amount i was supposedly overdrawn was £406.29 all authorised pin and chip payments! Abbey are now going to take £245.00 from our account at the end of April for us allegedly going overdrawn. It makes me feel sick, i feel ripped off, i can't believe they can get away with this!

    Sorry for ranting on, but if you're thinking of joining the Abbey - DON'T!
