if it helps, i would write to the information commissioner (you'll find the address in the section for reclaiming bank charges on the main page)
Tell them of the situation, as your clock started ticking when you first sent the letter on the 11th january! Like you said, they have well had their 40 days!
Maybe a reply from him can give them a rocket up their backside!
Did you say they told you it would take 6 weeks to change your address with them??!! Sounds like a stalling tactic to me!

I am at the stage where i have received an Acknowledgement of service from the County Court so i guess it is going all the way. I have just received two letters from Abbey National. (I am asking for £3000 including interest). The first letter is asking me for details on how i calculated my claim which i can do easy with the copy statements and the spreadsheet / calculator on this site but they have also asked for details on how the interest was calculated by reference to each charge. I dont know the answer to this, i basically followed the guidelines on this forum and used the calculator. They also want my email address and mobile number.
Should i respond to this letter? should i send them want they want? how do i word the bit about how the interest was calculated?
I have now just received another letter which is basically a copy of the defense they have entered at the court, they really are taking this to the very end. Does this mean i will be getting a questionaire sometime soon from the courts? is it normal for abbey to take it this far?
The interest is worked out at 8% Apr from the date that the money was taken out of your account by Shabbey to the date that you completed and filled in the calculator. Hope this helps.0 -

Hi there,
I am at the same stage now where they want details of the claim, they have offered me £120 so far (cheek! my claim is for nearly 3k!) which i forgot to take off when i filed the claim with MOL.
Do i deduct this from what i send them as i havent agreed to this.
then do i just send them what they want plus the same print out of list of charges as i have already sent them?
Any advice? (if there is a letter of what i write, can you tell me where to find it please?)

They credited my account too, but I sent a letter asking them to remove this money as I don't accept it, I wan't the full amount. You could too if u want.0

If Shabbey have credited your Account with a shameful GOGW you may as well keep it in your account as it will probably pay for the initial court costs, but do send them a letter saying that without prejudice you accept £### as partial payment and that the rest will still be claimed back via the courts. By putting without prejudice this means Shabbey cannot use this against you if you go to court.
And please send all letters via recorded delivery, it costs an extra 68p and Shabbey cannot deny that they've received the letter. It also gives you proof that you have given them 14 days etc..0 -

What you should have done is sent a letter stating that you accept the payment as a part payment and without prejudice but you will be continuing for the remainder of the amount through the county court

Thanks have sent everything recorded, so no worries there!
I received the letter saying that they will refund me the £120 after i filed the claim. And they will be sending it to a DCA anyway because i owe £436.60.
Even though i have received the letter asking for the charges and how i came to that amount, should i still send that letter you were talking about?
