    I don't know that answers to your questions but as long as you have followed the advice given on here then you KNOW you are in the right!!!
    Last week we got our money back from Barclays and they seem to be one of the worst. Nothing from them except the official stuff until three days before the court date and THEN they phoned us to settle all.
    We phoned our local court a few times with questions and they were very helpful - may be an idea although no doubt someone will be along later with more knowledge than me.
    Wanted to reply as I know how unsettling it is and you wonder if YOU are going to be the one who is taken to court although to be honest I think that is a long way away until at least the ruling is made.
    Power to us little people taking on the big boys (with all the help on here)!!!!!

    is this just not the normal replies banks give?

    use this site and look about in the forums as ALL banks say there going to defend as scare tactics but 1 never has

  • We also received their statement of defence this morning, it sounds like its the same as the one you received,which basically keeps referring to their terms and conditions: section 8 of the defence statement.

    "The claimants' contention that the said fees are unenforceable and/or are "penalty charges" is denied. The fees reflect and are proportionate to the defendants administrative expenses incurred due to the claimants breach of contract and are a genuine pre-estimate of the damage suffered by the Defendant."



    I look forward to seeing them in court, if they show.

  • I have recently claimed over £3.5K from Abbey. They offered me £860 which I refused. I asked them for 75% of my claim as a final "offer" and gave them 14 days to respond or I would file at court. They have sent me a letter telling me it could take them 4 weeks which is just another excuse for them to buy time!

    I really don't want the stress of taking them to court - should I ring them and try to get a settlement over the phone???

    I'm not very good at stuff like this so any advice welcome!

  • i am in the process of taking abbey to court and they are defending, i am waiting for a court date. i have just realised i have made a huge error and calculated 7 yrs instead of 6. what can i do so late into the proceedings.

  • Hi, This is my first post so I hope I'm doing this right.

    Ok, so I'm claiming £401.00 from my single account and £2500.00 from my joint acc.

    I sent a letter to them asking for money back on 26th February. On 9th day after I had sent letter I recieved a delaying letter saying we're looking into it blah blah blah and then I sent another letter on 14th day threatening court action. On the 28th March I recieved the letter below.

    I'm writing out the whole letter as I have found it very useful when others have done this on this site (so I know what to expect)

    Can someone tell me what I should do next please ????Has anyone else recieved this letter?

    Dear .........

    Thank you for your letter dated 26th February 2007, about the charges on your bank account. I have now carried out a full investigation on your behalf.

    I'm sorry you are unhappy with the charges and understand you would like these refunded. Although the charges were correct, as a gesture of goodwill, I am happy to refund £620.00. Your account will be undated within the next 10 working days (the money came in on 29th March)

    I appreciate your feelings on this matter but we are satisfied that the charges do not contravene the unfair terms in consumer contracts Regulations 1999. We also comply with the office of fair trading, in dealing fairly and openly with our customers.

    I can inform you that your charges are based on the extra administrative work incurred by Abbey when, for example, an account has insufficient funds to meet a requested payment. Abbey believes that it is reasonable to make a charge on such an occasion to pass on the costs incurred by the bank and that the charges applied to the account are fair and transparent. Should you require details of the specific charges applicable, these are stated in the terms and conditions of your account.

    Please be assured I have carried out a full investigation for you and I hope you feel I have offered a considered and complete response to all of your issues you have raised. I will keep you file open for 8 weeks and if I dont hear from you within that time , I will assume that everything is resolved and will close your file. If you remain dissatisfied though, the leaflet you'll find with this letter explains your rights and how to take your complaint further within Abbey. The address to contact is
