on the 25th of feb i send off my first letter with £10 .00 attached to it. i then recieved a letter from abbey (pam speed) telling me that they will send me 14 mths of statements and that i would need to send them £10.00 for the other 4 years and 10 months.i contacted abbey and told them that the £10.00 was attached to the letter i sent thhem in feb, i was told not to worry about it and to contact them again in a few weeks time. i contacted abbey yesterday to ask them abut my statements and i was told that abbey no longer discuss anything to do with statements and that i just have to wait and see what happens0

Without knowing precisely what is in the defence my advice is that google is your best friend and the search function on this siteAnything in their defence has probably been used before somewhere before with someone else and there will more than likely be information available to counter it.
Any particular difficulty you have post a question and I am sure someone will be able to answer.
Once researched and if you are confident that your claim is sound dont worry. You will receive a court Allocation Questionnaire and there is help to fill it in here:

Your claim is less than £1,500 so there is no fee payable. Above this amount and dependant on income the fee is usually £100.

Hi I sent letter 2 to abbey early in march, I recieved a letter yesterday 30th dated 23rd offering me 1/3 of the ammount I am claiming. I have gone to my account today and that offer amount has been put in to my account already. I only posted the 3rd letter to them today. what should i do ?0

Unfortunately, i've a feeling that Abbey may be playing unfair...
Got about 50 pages of "microfiche" that do not show any charges... Though for some reason - the dates of the transactions are sometimes not in order, and i appear to have debits for "interest debit" which i assume is interest charged while i was overdrawn -though have no "fees" shown anywhere, ever.
Has anyone else found this... My thinking is that they have failed to answer my access request within 40 days - but i can't progress a claim as i have no idea what i should be claiming....!

You need to go back to them and say you need to have the information in a form that you can read and preferably copy statements.

Hi everyone, I finally recived my statements of charges on my account and just want to know before i work them out on the calculator wether i should include the 'INT DEBIT' and 'COUNTER FEE's too. would love a quick reply so i can get my letter sent off a.s.a.p( shabby waited the full 40 days to send these, although i dd send them the letter about informing the information comissioner on 27th march). I've received 1 yr of statements so far, still wating for the rest, but will stick to the timetable with the shabbey. But I've notice a £10 miscellneous credit has appreared in my account yesterday. Do you think they have refunded my £10 for the 6yr's worth of statements? Anyone else had this?
Hello Nejen, yes I have had this. I started my claim on the 8th Dec 2006. I waited more than the forty days for a reply. My account with Abbey is frozen and in the hands of a debt agency. So Abbey then put my £10 cheque back into my closed account, without telling me, or sending me a statement. When I found out I had to resubmit my first letter with another cheque and wait another forty days! Abbey wrote and apologised as their customer service is of a very high standard apparently. If this happens to you DO NOT RESTART YOUR 40 DAYS. They are in the wrong, remind them of your request and that the clock is already ticking.LegalBeagles0

Revieved Abbey's defence. It has also been forwarded to my local court. When I received the letter from the court they had crossed out the part that says that the AQ is enclosed and it just enclosed a copy of Abbey's defence. Has anyone else had this? What happens now?

Abbey have decided to defend have just sent back the ALLOCATION QUESTIONNAIRE.
I am claiming £980 and Abbey have allready paid back £570 to my account (I have not said I will settle for this) There has been no other offer to settle out of court. Should I just let the court proceedings run? as I am beginning to doubt my own calculations or is this just what the bank wants!0
